AGREEMENT FOR THE BLINN COLLEGE DISTRICT DUAL CREDIT PROGRAM
This Agreement for the Blinn College District Dual Credit Program (Agreement) is by and between BLINN COLLEGE DISTRICT, a public community college established under Chapter 130 of the Texas Education Code and a political subdivision of the State of Texas, (College), and a public school district/political subdivision of the State of Texas,
Bellville ISD
a Texas Public independent school district and political subdivision of the State of Texas (“District”) with an effective date of June 1, 2024 (Effective Date). Individually, the College and the District shall be referred to herein as “Party” and collectively as “Parties”.
RECITALS
WHEREAS, Texas Education Code (TEC) §§ 28.009, 29.182 to 29.184, and 130.0088; and 19 Texas Administrative Code (TAC) Chapter 4, Subchapter D and Chapter 9, Subchapter H authorizes the creation of processes to encourage dual credit with a public school district for the provision of instruction for college courses to eligible high school students for both college and high school credit; and
WHEREAS, the College and the District desire to establish a dual credit program (“Dual Credit Program”),
NOW THEREFORE, the undersigned Parties agree to the following in consideration of the mutual covenants and promises contained in this Agreement:
SECTION 1. DUAL CREDIT PROGRAM OVERVIEW
A. Blinn College Dual Credit Program
- Dual Credit is a process through which a student may earn college and high school credit for a college course. Upon successful completion of a dual credit course, the student receives credit from both the high school and the College.
- The courses offered as dual credit will comply with the Texas Higher Education Coordinating Board’s (THECB) Lower Division Academic Course Guide Manual (ACGM), Workforce Education Course Manual (WECM), and/or Blinn College catalog for each academic year.
- The College will submit an annual agreement, in compliance with the Texas Administrative Code, THECB, and Southern Association of Colleges and Schools (SACSCOC) standards.
- In accordance with Applicable Law (as hereinafter defined), the College will offer dual credit courses listed in the current edition of the Texas Higher Education Coordinating Board’s (THECB) Lower Division Academic Course Guide Manual (ACGM) and Workforce Education Course Manual (WECM). Courses offered in each semester shall be determined by the College and agreed upon by the District/School. Courses provided by the College under this Agreement shall be consistent with the educational purpose, mission, and goals of the College and shall be under the direction of the College. Developmental courses are not eligible for dual credit students. Kinesiology courses that do not count toward required core curriculum are not eligible for dual credit students.
- Dual credit courses may be offered during any semester in a location and classroom mutually agreed upon by the School and College. The College will determine the logistics of offering courses at School and College instructional sites. The criteria used to establish a course at one of the above sites will include, but not be limited to, student demand, available faculty, and required resources. Each Party reserves the right to cancel a course in the best interest of the respective entity if appropriate criteria are not met.
- Dual credit courses must address the applicable Texas Essential Knowledge and Skills (TEKS) requirements. A course equivalency crosswalk is published annually. All course syllabi, assignments, and other course materials must be comparable to the same course offered at the College.
- If a dual credit course is canceled, the College will communicate such changes to the District/School as early as possible.
- Students must maintain satisfactory academic performance for continued participation under this Agreement. The minimum grade for course eligibility and approval is specified in Appendix A.
- The College reserves the right to set a minimum number of students for regularly-ordered courses. If this minimum is not met, the College reserves the right to cancel the course.
- The College strongly encourages dual credit students taking classes online to have an in-school time scheduled to work with a high school proctor.
B. The School
- The School is responsible for providing a learning atmosphere and classroom facilities comparable to the ones offered on the College campus, regardless of modality of instruction.
- The School will provide instructional technology and other auxiliary equipment typically used in support of classroom instruction.
- The School will provide facilities, personnel, and equipment to meet the particular requirements for the online/internet, Interactive Video Conference (IVC). Appendix B describes video class regulations.
- The School will identify an instructional lead person, as applicable and as agreed upon between the Parties, who will provide supervision of the students during all times while students are in the location or participate in a dual credit course, and serve as the liaison to the College.
- The School will ensure student supervision and compliance with policies and procedures set forth in this Agreement, in consultation with the College.
- The School will notify students and parents of the requirements for registration and participation in the Dual Credit Program in accordance with Applicable Law.
- Whereas the College will follow existing Board of Trustees policies with regard to assigning a grade for College credit in the dual credit courses, if the College grading scale differs from the District’s grading scale, the District/School will provide participating students with a comparative document aligning both the College grading scale and the District’s grading scale. See Appendix A.
- Although a student may pass a College class with a grade of D, the District/School shall be responsible for communicating to students and parents that under 19 TAC § 74.26(c), credit for courses for high school graduation may be earned only if the student received a grade which is the equivalent of 70 on a scale of 100. College personnel will not be expected to communicate with parents. See Appendix A.
C. Applicable Law
- The Parties agree to operate the Dual Credit Program and perform their obligations under this Agreement in compliance with all applicable state and federal statutes, regulations, and administrative rules and guidelines. Such statutes, regulations, and rules may include, but are not limited to, Title IX of the Education Amendments of 1972, as amended, Section 504 of the Rehabilitation Act of 1973, Family Educational Rights and Privacy Act (FERPA), the Americans with Disabilities Act (ADA), the Texas Education Code, and rules and regulations promulgated by SACSCOC, Texas Education Agency (TEA), and the Texas Higher Education Coordinating Board (THECB).
- References to Applicable Law in this Agreement are deemed to refer to the entire subject matter of the law, regulation, or other requirement, including any amendments, revisions, or changes made to it after the Effective Date of this Agreement.
References in this Agreement to the subject matter of this Agreement collectively shall be referred to as "Applicable Law" or "Applicable Laws" when used in this Agreement.
The Parties agree:
- To certify that their sites are Americans with Disabilities Act (ADA) compliant;
- To comply with all applicable provisions of the Family Educational Rights and Privacy Act, 20 U.S.C. §1232g;
- In all cases, to comply with all federal, state, and local laws applicable to this MOU; and
- To have in place and abide by policy prohibiting discrimination, including harassment, based on sex, race, color, national origin, religion, age, disability, or any other basis prohibited by law.

BLINN COLLEGE DISTRICT STATEMENT ON PARENTING SERVICES

SECTION 2. DUAL CREDIT ADMISSION – STUDENT’S REQUIRED ACTIONS
A student will be considered college ready for admission in which the student demonstrates academic performance and college readiness as defined by the laws in accordance with Applicable Law. The following requirements for admission eligibility must be met:
- Obtain written approval from the appropriate high school principal or designee for participation in the Dual Credit Program and for individual course registration.
- Meet all college admissions requirements and procedures, including, but not limited to, submission of an application for admission, high school transcript, and any other required documentation requested by the College.
- If the student is under 18 years of age and not graduated from high school, the student’s parent or guardian must sign the required agreement and consent forms.
- Meet the Texas Success Initiative Assessment (TSIA/TSIA2) standards or meet a state-approved exemption, as required for the given course(s). The TSIA/TSIA2 may be waived, as specified in TAC Chapter 4, Subchapter C, for students who are enrolled in college preparatory courses.

Immunization:
- Proof of Bacterial Meningitis Vaccine. The College, in compliance with TEC § 51.9192, requires the bacterial meningitis vaccination for all new students enrolling in classes after January 1, 2012. Students must provide to the College Enrollment Services Office a certificate signed by a health practitioner indicating that they have been vaccinated against bacterial meningitis. This requirement does not apply to dual credit students taking classes exclusively at a School facility, or for completely online students. Dual credit students taking classes in-person on any Blinn College Campus must provide proof of the meningitis vaccination. Refer to http://www.blinn.edu/administration/health/meningitis.html for detailed information regarding bacterial meningitis requirements.
- Students who are privately or in non-accredited secondary schools or who are homeschooled must meet all admission requirements for new students.
SECTION 3. CLASSES AND SCHEDULES
- Prior to the start of each semester, the College will coordinate and finalize the provision and scheduling of dual credit courses. The District/School shall confirm the course schedule each applicable semester. Course offerings are subject to minimum and maximum course enrollments and other factors as determined by the College prior to the beginning of each term. The District/School will provide the College with an official class roster and official grade reporting for students enrolled in dual credit classes.
- A student may not be enrolled in a course at the College for which the student has not satisfied the prerequisites required for the course as stated in the College Catalog. Placement into certain courses, including English, Mathematics, and Reading, may be based on meeting minimum TSI/TSIA2 scores and/or course prerequisites. For career and technical education (CTE) courses, students must meet any required industry credentialing and/or certification requirements.
- Students must follow the registration procedures set forth in the College Catalog for course additions, withdrawals, and drops. Deadlines for adding, dropping, and/or withdrawing from dual credit courses are published in the academic calendar.
- If the student is eligible for the College-exempted courses under the terms of the applicable articulated course, the dual credit class can include a combination of technical dual credit students, college credit students, and/or local articulation students.
- E. In order for the College to provide face-to-face instruction for an academic dual credit course on the School’s or another high school campus, the campus must be within a reasonable commuting distance from a College campus, a minimum class size number will be required. The Parties agree that the minimum number of students for a dual credit course in which the instructor is to provide face-to-face instruction may be composed of students from the District/School as well as one or more other school districts served by the College. If there are fewer than the minimum number of students required, the Office of Dual Credit Programs will coordinate with the District’s dual credit representative to explore enrollment alternatives. The College will not provide transportation.
- If the College provides faculty to offer face-to-face instruction on the School’s campus, students are responsible for their own transportation unless otherwise agreed as determined by the Divisional Dean.
SECTION 4. FACULTY
As per SACSCOC accreditation guidelines, dual credit courses are offered in adequate physical facilities, whether under the control of the College or under the control of the School. The College will assess the facility prior to the beginning of instruction and periodically review facilities to ensure compliance.
SECTION 5. FACILITIES
College and District/School representatives at each site will assess the facilities, determine the site needs, and select the instructional modality.
SECTION 6. FINANCIAL AID FOR SWIFT TRANSFER (FAST) PROGRAM
The state of Texas has created the Financial Aid for Swift Transfer (FAST) program. FAST provides funding to colleges so they can offset the cost of dual credit courses to educationally disadvantaged students at no cost to those students. The Texas Higher Education Coordinating Board (THECB) defines "educationally disadvantaged" as students eligible for the federal income eligibility guidelines for the national school lunch program. The classes must be reported as FAST eligible students.
Students are eligible to enroll at no cost in a dual credit course under the FAST program if the student meets all of the following:
- Is enrolled in high school in a school district or charter school;
- Is enrolled in a dual credit course at a participating institution of higher education;
- Is educationally disadvantaged at any time during the dual credit course described herein.
The Parties will work together to verify FAST-eligibility for each student and dual credit eligibility for each student enrolling in the Dual Credit Program. Students not eligible for FAST must pay the cost for college credit, which is set by the College as the cost of tuition and fees for dual credit students as published in the current Blinn College District catalog. Students classified as economically disadvantaged and eligible for FAST will be reported to the THECB on the state’s FAST roster prior to the start of fall course work in dual credit. The District/School will identify and verify with the College the list of students to be included in the FAST program. This eligibility must be verified and completed by August 5th (or other date as stated by the THECB).
Students eligible for dual credit who do not qualify for FAST may select the option(s) below approved by the state:
- Option 1: The District/School pays the State of Texas approved tuition rate for the current academic year.
- Option 2: If a qualified and approved instructor employed by the District is utilized for a course and the College does not pay the student instructor, the following calculation rate: THEN, a NON-FAST student would only pay $20 per credit hour (e.g. $60 for a three credit hour course, or $80 for a four (4) credit hour course). Additionally, under this option, the District will receive a reimbursed service payment of $500 for each course section of dual credit. A minimum of eight (8) students are required for each course in the Dual Credit Program.
*During the Term and as further specified in this Agreement, the credit hour tuition and fees will be the rate for dual credit students published in the College’s catalog or Texas or the State of Texas. - Option 3: If a qualified and approved instructor employed by the District is utilized for a technical (WECM) dual credit course, tuition will be based on compensation to the instructor. THEN, the tuition may be less than the normal technical course as waived (e.g. there is no cost to the student/District/School), but this applies only for those taught on high school campus by a high school teacher.
SECTION 8. COLLEGE FACULTY COMPENSATION
- Full-time Faculty: Board of Trustees or the President sets the rate.
- College adjunct/part-time qualifications: As per current College policy.
SECTION 9. LEARNING RESOURCES
- The College provides library resources for dual credit students, including online databases, as well as on-site access to library resources at the College library.
- Only dual students and instructors may use the items and other services available at the College or the College Campus. District/School staff has access to the College’s online library resources. Circulation privileges and access services are restricted to active students. Appropriate staff for the Dual Credit Program are invited to access library facilities and services upon appointment only.
SECTION 10. ACADEMIC ADVISING AND STUDENT SUPPORT SERVICES
- Each Party designates an academic advising contact for the dual credit program.
- Support services—Dual credit students may use the computer labs, writing centers, and learning centers at any of the College's campuses.
SECTION 12. STUDENT CODE OF CONDUCT
- Dual credit students must comply with College policies and procedures including the Student Code of Conduct as outlined in the College Catalog. (http://catalog.blinn.edu)
- Students must comply with the College’s academic integrity standards. (link)
- If a student is asked to leave the classroom because of uncivil behavior, the student must immediately return to the high school administration for evaluation. It is the student’s right to protest suspension or expulsion through due process as outlined in the College’s Codes of Student Conduct, section FLB.
SECTION 13. FUNDING AND PAYMENT
- Tuition and fees for dual credit students are set by the College Board of Trustees and published in the College Catalog. The College will notify the District/School prior to changes in the tuition and fee schedule. The College may reduce tuition and fees for students enrolled in dual credit courses and classes in a Field of Study or Program of Study.
- If a student requests to take a class more than twice, he or she will be responsible for the tuition and fees not subsidized as 30.00 per semester hour (for the course. Technical courses and FAST-eligible students are exempt from this fee. (see Blinn College Catalog – College Expenses)
- The College is not responsible for the transportation of dual credit students.
SECTION 14. RECORDS AND REPORTING
- Class Rosters: The College will provide class rosters (listing the names and grades in a formal manner of dual credit students completing the course) to the School at the close of each semester.
- Student Records; Record Retention: FERPA. In accordance with Applicable Law, each Party will maintain student records and may retain records as necessary to operate the Dual Credit Program. Provide the other Party just-in-time access to the student’s information required to ensure program success. Both Parties agree to comply with all applicable policies with respect to the Family Educational Rights and Privacy Act of 1974, as amended (FERPA), and the Texas Records Retention law. Each Party designates the other Party as a school official for the limited purpose of reviewing student information for records compliance. Each Party will maintain its own student transcripts, and in accordance with FERPA and other applicable laws, both Parties will not disclose any record, academic or otherwise, to any third party except as specifically authorized by law.
SECTION 15. CONFLICT RESOLUTION
Conflicts should be resolved at the lowest level possible with an understanding that, if no agreement is reached, there is a process for advancing the conflict through each Party’s organization. The key approach will be to maintain communications with early discussion sought on issues/conflicts and solutions summarized in writing after each discussion. In order to be collaborative, the College must be able to communicate with the administrators on campus in which the dual credit students/programs are present.
Each Party shall designate an administrative liaison for the purpose of resolving concerns at both the campus (liaison must be Principal or other designated campus administrator) and the College (Director, Dual Credit Programs) level. If a resolution is not found at the initial level, the conflict resolution process shall move to the respective District superintendent or College Vice President of Instruction (Direct report of Instructional Division or their authorized assigned Agent). If the conflict remains unresolved, it may be presented for final determination to the President and the Vice Chancellor, Student Services and Enrollment Management. If the resolution cannot be found at this level, the matter in dispute may be handled through the Parties’ respective legal counsels.
SECTION 16. TERM AND TERMINATION
- If any Party determines that continuation of the Agreement is not appropriate, that Party shall provide written notice of termination to the other Party at least ninety (90) days prior to the effective date of termination.
- Upon termination, both Parties shall comply with any and all requirements to wind up their obligations, including the resolution of all students currently enrolled in dual credit courses.
SECTION 17. GENERAL CONTRACT TERMS
- A. Entire Agreement
- This Agreement, including the Recitals, the Appendices, and any exhibits, all of which are incorporated herein, constitutes the entire agreement of the Parties regarding the subject matter herein described. This Agreement supersedes all negotiations or previous agreements between the Parties with respect to the subject matter hereof. The Parties expressly acknowledge that in entering into such an agreement the Parties rely solely upon the representations and agreements contained in this Agreement and no others.
- B. Amendments
- This Agreement may be modified and amended only by written agreement signed by both Parties, and any such modification or amendments shall be attached and become a part of this Agreement.
- C. Governing Law; Venue
- This Agreement and the rights and obligations herein shall be governed, interpreted, and construed under the laws of the State of Texas without regard for its conflict of laws provisions. The Parties irrevocably consent to the sole and exclusive jurisdiction and venue of the courts of Washington County, Texas.
Notice. All notices required by either party shall in writing and delivered (1) personally, (2) by registered mail, registered return receipt, or (3) by email and U.S. certified mail, return receipt requested to the address below, unless otherwise provided for in this Agreement or as provided in writing by either party in the future.

- In the performance of their respective duties hereunder, the Parties hereto and their respective employees and agents, are at all times acting and performing as independent contractors of each other (notwithstanding the foregoing, employees of the District may teach college courses as adjunct professors of the College or through some other teaching arrangement, if such arrangement is approved in advance by the Parties). This Agreement does not create a partnership or joint venture between the parties hereto, nor does it authorize either Party to serve as the legal representative or agent of the other. No Party will have the authority to act for or bind another Party in any respect nor to incur or assume any express or implied obligation, liability, loss, or responsibility on behalf of or in the name of another Party hereto. Neither party shall have the authority to act for or bind with respect to its obligations hereunder, any employee or agent of the other party by reason of this Agreement.
- E. Non-Waiver
- No waiver of any obligation under this Agreement is effective unless in writing and signed by both Parties. Any waiver of a provision of this Agreement is not a continuing waiver unless so stated in writing.
- F. Assignment
- Neither Party may assign or transfer this Agreement or any of its rights, interests, or obligations hereunder, without the prior written consent of the other Party, and any attempted assignment or transfer without such prior written consent shall be void and of no effect.
- G. Severability
- If any provision of this Agreement is declared invalid, that invalidity does not affect any other provision, all of which remain in effect.
- H. Binding Effect
- This Agreement shall be binding upon, and inure to the benefit of, the Parties hereto and their respective successors.
- I. No Third Party Beneficiary
- No individual or entity is intended to be or is a third party beneficiary of or under this Agreement.
- J. Counterparts; Electronic Signatures; Electronic Transmissions
- This Agreement may be executed in identical counterparts, all of which will be deemed an original, but all of which will constitute one and the same instrument. Each Party may rely on facsimile or electronic signature pages as if such facsimile or electronic pages were originals. The Parties consent to receive documents, information, and notices via electronic mail.

APPENDIX A
Regarding Grading System
EGA(LOCAL) and Current College Procedures for Grading and Credit
The Board shall establish the manner in which grades shall be determined and credit shall be awarded. These provisions shall include the methods for reporting student grades, the calculation of a student’s grade point average (GPA), the classification of students based on credit earned, the transfer of credit, student standards of performance, grade appeal procedures, and any other relevant matters. The provisions shall be published in the College District catalog. The Chancellor shall develop administrative regulations to implement the grading and credit provisions, as necessary. For the most current procedures, see EGBJ.
CURRENT COLLEGE PROCEDURES FOR GRADING AND CREDIT
Grades
At the end of each semester, students shall receive a letter grade for each course attempted as part of their permanent record. The College’s grading system shall be followed.

I - Incomplete: indicates that the coursework was incomplete because of serious illness or other justified emergency. The instructor shall change the grade of “I” to a grade based on the work completed for the course in addition to the work specified in the course completion contract. All incomplete work shall be completed within 90 days of the start of the next long semester. Failure to complete the work specified in the course completion contract shall result in a grade of zero, which shall be factored into the final grade calculated with appropriate weighting relative to other course grades.
Q - Dropped: assigned before or on the official “Q-Date” as indicated on the College calendar when a student has officially dropped from a course.
A “Q” may also be given after the “Q-Date” if the instructor has assigned the course on the official drop is processed.
W - Withdrawal For Good Cause: assigned when a course equivalency crosswalk is indicated to the College calendar when a student has officially withdrawn by ability to satisfactorily complete the course or program due to a catastrophic event (such as a justified emergency).
The grade of W is for administrative purposes only and does not affect the student’s grade point average. Courses dropped prior to the “Q-Date” have a “Q;” courses dropped after the “Q-Date” have a “W.” For further guidance, refer to College procedures and policies on withdrawals and drop dates.
GRADE EXEMPTION
Students not meeting these standards in competitive entry programs may continue to enroll in courses outside the discipline as long as they maintain minimum college required performance level.
Grade Point Average (GPA)
College progress is measured annually by a grade point average or ratio. Grade points shall be calculated by assigning values to each grade. The value is illustrated in the chart below:

In the highest grade of a repeated course shall be used in determining the cumulative grade point average. A grade of “W” or “Q” will not replace a grade of “F” or higher in a repeated course, but a grade of “F” shall replace a grade of “W” or “Q”.
All grades earned while enrolled in the College shall be used in computing a student’s College grade point average (GPA). Students who transfer to the College from another institution shall have only Blinn College grades included in the student’s College Cumulative GPA.
Academic Good Standing
In order to remain in academic good standing with the College, a student must maintain a cumulative grade point average of at least 2.0 (C). A 2.0 cumulative grade point average is the minimum average required for graduation.
Scholastic Probation or Suspension
A student who falls below a 2.0 cumulative grade point average (GPA) at the close of any long semester or summer school will be placed on scholastic probation.
A student who fails to achieve a minimum 2.0 semester and cumulative GPA at the end of subsequent semesters will be placed on scholastic suspension. A student with a semester GPA of greater than 2.0 and a cumulative GPA of less than 2.01 will remain on scholastic probation. Students being placed on scholastic probation will receive an email about their Blinn College account. Students being placed on scholastic suspension will receive an email at their Blinn College account.

I understand that I am responsible for my conduct and for the grades I earn in each college credit course in which I enroll.
