The provisions of this agreement shall constitute and supersede all previous agreements, oral or written, for the Dual Credit Program between the College and the District and are effective as of June 1, 2024 (Effective Date). Individually, the College and the District are referred to herein as “Party” and, collectively as “Parties”.
District
WHERAS, Texas Education Code (TEC) §§ 28.009, 29.181, and 130.008; and 19 Texas Administrative Code (TAC) Subchapter D and Chapter 9, Subchapter H authorize an institution of higher education and a public school district for the provision of instruction resulting in dual credit received by a student for both college and high school credit; and
WHEREAS, the College and the District desire to establish a dual credit program (Dual Credit Program) to be operated as part of the District’s curriculum for high school (School);
NOW THEREFORE, for the mutual promises and covenants contained herein and other good and valuable consideration, the Parties agree as follows:
SECTION 1. GENERAL CRITERIA
A. Blinn College District Dual Credit Program
- The College will designate a Dual Credit team to be in charge of the management and supervision of the dual credit program.
- The College service area includes the following thirteen counties: Austin, Brazos, Burleson, Fayette, Grimes, Lee, Madison, Colorado, Waller and Washington Counties as parts of Milam, Montgomery, Robertson and Walker Counties.
- The College will ensure that dual credit courses follow the same quality, credentialing, content, rigor, and outcomes taught to the institution’s other students (SACSCOC) standard.
- The faculty employed by the College offering dual credit courses will meet the SACSCOC credentialing guidelines. Dual credit courses are offered in academic subjects for which the College has degree programs.
- The courses to which dual credit is applicable are listed for each high school partner in Appendix E. Courses not listed must be approved and credentialed for teaching dual credit.
- Dual credit courses may be offered at the high school, on a College campus, at a college center, electronically, or via a combination of these delivery methods. The high school is not responsible for the school’s on campus, student discipline related to students enrolled in College credit courses.
- The College will assist students with the College application and College readiness testing through guidance counselors and other resources at the College.
- Dual credit students must meet satisfactory academic progress on both the high school and the college transcript as defined by local policy.
- The faculty evaluation process is applicable. District, School, and College regulations and procedures apply as appropriate.
- The faculty teaching dual credit courses will be compensated at their contractual rate.
- College adjunct instructors will be compensated per current Board Policy.
B. Dual Credit Student Policies
- Dual credit courses will be identical or equivalent to those offered at the College. Students will adhere to current policies and procedures for registration, class enrollment, drop, and withdrawal dates, grades, and procedures for making the transition from high school to the College.
- The School will provide facilities, personnel, and equipment to meet the practical requirements for on-site/Internet, Interactive Video Conference (IVC), Appendix B describes video class requirements.
- The School will furnish the professional-level personnel, as applicable and as agreed upon from the Parties, who will be responsible for identifying, advising, and serving prospective students (College application participation, Dual Credit Program in accordance with the applicable law.
- The School, with support and training from the College, will assure registration functions, including, but not limited to, counseling, applications and admission forms, and Parental student documentation.
- The College will maintain effective processes for course recommendations due to disability by students with documentation outlining recommended accommodations and services under an Individual Education Plan (IEP). It is the School’s responsibility to provide the IEP documentation from the School/District’s Office of Disability Services (ODS), as applicable.
- Application for the School/District IEP documentation from the student, the College’s ODS provides a written notice to the School. Please note that parents are instructed to contact the College’s ODS to commence this process as soon as their appropriate application from the College ODS has been received; therefore, it is critical to complete the accommodation notice to ensure students receive their accommodations. For additional information, please contact the College’s ODS.
- Students that may pass a college-level course, but not the required standard of D, the District/School will be responsible for communicating with parents and teachers that under 19 TAC § 74.26(i), credit for courses requiring both college and high school graduation physical education requirement will not be offered to dual credit students.
- Dual credit students are not affected by the provisions of TEC §51.907. Therefore, dual credit students with Q grades will be recorded as a W and will not be penalized as one of the allowed six-state-drops.
C. Applicable Law
- The Parties agree to operate the Dual Credit Program and perform their obligations under this Agreement in accordance with the applicable federal, State, and local laws, implementing regulations, executive orders and other requirements, including but not limited to:
- Title IX of the Education Amendments of 1974; Section 504 of the Rehabilitation Act of 1973; the Age Discrimination of 1975; the Family Educational Rights and Privacy Act of 1974 (FERPA);
- The Family Educational Rights and Privacy Act of 1974 (FERPA);
- The Americans with Disabilities Act;
- The Texas constitution; and
- All federal statutes regarding the confidentiality of records regarding students and student information technology access and use by students.

BLINN COLLEGE DISTRICT STATEMENT ON PARENTING SERVICES
Any student who, because of their pregnancy or parenting status, may require special arrangements in order to meet the academic requirements of their courses is required to contact the instructor as soon as possible. Please note that the instructor is not allowed to provide classroom accommodations to a student until verification from the Parenting Services Office has been provided. For additional information, please contact the Parenting Services Office.
SECTION 2. DUAL CREDIT ADMISSION – STUDENT'S REQUIRED ACTIONS
- Students may attend the College during the semester in which the student demonstrates readiness for College-level courses or otherwise is eligible in accordance with Applicable Law. The following requirements for admission must be met:
- Obtaining written or electronic permission from the high school Principal or the Principal’s designee, or from an adult parent or guardian using the Dual Credit Approval Form, as set forth in Appendix C.
- Earning a "B" or better average in all high school work completed for the WBMCI grades courses – if the student is approved for a course and receives a grade lower than a B during the course, the grade may not be provided as a grade for the semester. The grade for the student’s credit will be the grade in which the student officially drops or withdraws from the College course.
- Completing College application for admission at ApplyTexas;
- Meeting the following requirements for placement as determined by State law:
- Being assessed by current TSI rules or testing, or having exemptions in accordance with State law. First time college students may be required to have a student identification number as determined by the institution.
B. Students who are in private or non-accredited secondary schools in the prior school year must meet all admission and assessment criteria for which or who are homeschooled will meet all admission and assessment criteria, as documented in writing.
SECTION 3. CLASSES AND SCHEDULES
- Prior to the start of each semester, the College will coordinate and facilitate the process of scheduling courses with a timeline manner. To finalize the enrollment for any students prior to the semester, the scheduling information with the official calendar shall be shared across a College as it becomes necessary. The counselor, in consultation with the designated School administrator, should submit the proposed course schedule for the next school year by July 20th prior to the beginning of the school year.
- The schedule should be next enrolled in a dual credit course will follow the District/School calendar regardless of dual credit class location; course cancellation should be processed through the College administration and the School administration should cancel a class unless it is absolutely necessary. The cancellation between the scheduled partner and the College would otherwise result in the rapid replacement utilizing coursework or course replacement as allowed under Dual Credit/Pathways or School of the College. If permitted in the Dual Credit Program, may include the number of academic days as permitted by the College Board policy.
- Academic credit will enter the School’s/District’s transcript once the Dual Credit Program academic counselor with courses must be taught in preapproved College's Dual Credit Program; or from the chosen model for guiding placement students. In the case of technical classes these classes being approved as of the designated Division Dean or Vice Chancellor.
SECTION 4. FACULTY
- The faculty assigned by the College to instruct dual credit courses will meet the requirements for credentialing guidelines set by the College. Each application, interview, hire for a district/school employee who is to offer or otherwise an College employee, will be required to complete the hiring process as required for College instructional staff. Each candidate must submit resume, complete new criminal record background check, and attend faculty orientation.

- The faculty teaching dual credit courses must be evaluated using the same process as other College faculty according to applicable District, School, and College regulations and procedures.
SECTION 5. FINANCIAL AID FOR SWIFT TRANSITION (FAST) PROGRAMS
The State of Texas has created the Financial Aid for Swift Transfer (FAST) Education Code (TEC) defines “educationally disadvantaged” as those students eligible for federal or state public education funding solely due to their eligibility for free or reduced price lunches. These students are eligible for FAST eligible students.
Eligible educationally disadvantaged public high school students are afforded cost of a FAST eligible course and thus may not be charged for tuition or enrolled in a course at a participating institution of higher education.
Blinn College will be able to enroll all eligible Dual Credit Program students tuition-free if the student is enrolled in a dual credit course at the participating institution.
- Students with satisfactory academic standing may be eligible for a tuition exemption under FAST programs. Students that are not eligible must pay tuition and fees by August 5th.
- The College is eligible to enroll eligible Dual Credit Program students tuition-free for the cost of instructional materials required for the course. This verification shall occur annually by the College.
- The parties will work together to verify FAST-eligible students and dual credit registrations for each school district enrolling in the Dual Credit Program. For Non-FAST eligible students enrolled in dual credit, the remaining tuition will be charged by the District/School per student basis, unless the FAST program requires that FAST eligible student cost of books, supplies, and other course materials must also be provided or waived. A cost split is applicable per student.
SECTION 6. FACULTY COMPENSATION
The faculty teaching dual credit courses shall include the following information in pay tuition for Option 1 and if a dual credit instructor is a College or District employee (provides meet the dual credit instructor requirements) as follows:
- WHEN: IFCM, dual credit instructors who are in accordance with the option(s) below:
- THEN: A non-FASST instructor credentialed and teaching the employee provides meet the dual credit instructor requirements as outlined in the College’s Board of Trustees for the dual credit instructor approval process noted in the faculty guidelines below.
SECTION 8. COURSES & COLLEGE FACULTY COMPENSATION
- College faculty will be compensated per contract.
- College adjunct instructors will be compensated per contract.
- Dual Credit courses will be compensated per contract.
SECTION 9. SYLLABUS, CURRICULUM, SUPPLIES, AND TEXTBOOKS
- As in accordance with THECB regulations and SACSCOC, Dual Credit classes must have the same curriculum, materials, grading, and rigor in all College classes regardless of location or modality.
- A College campus must be used to connect for course materials and evaluate requirements. College policies and elements of the master course syllabus including, but not limited to, course outcomes, lesson schedule, course requirements, College policies, and instructors’ course materials (e.g., as well as the schedule).
- Dual Credit courses will use identical or equivalent textbooks, the courses offered on campus. The College is not responsible for providing textbooks to the School for each class tuition and applicable College tuition waiver will be provided as described for Swift Transfer (FAST) program. Students that are not eligible for Financial Aid for Swift Transfer (FAST) must purchase or rent the required textbooks. Students identified as FAST eligible will not incur the cost of purchasing new or additional resources required for the class(es). Cost of books, supplies, and other course materials must also be provided or waived.
SECTION 10. LIBRARY AND LEARNING RESOURCES
Dual credit students and instructors may use the library services offered by the School or any of the College campuses. Resources are available and access to the College’s online library system. Instructional programs and other resources of varied media and instructors who are part of the Dual Credit Program are identified to be provided to all College students.
SECTION 11. ACADEMIC ADVISING AND STUDENT SUPPORT SERVICES
- The College will provide adequate instructional support services, including academic advising for students to enable completion with merit and distinction. The Parties shall take necessary actions to ensure compliance with any and all student eligibility as prescribed by state law for dual credit students. The parties agree to take all due diligence to enable instruction and advising with any student who enrolls in a dual enrollment course before beginning the College credit. Dual credit colleges remains available for ongoing advising and support.
- Support Services—Dual credit students may use the computer labs, writing centers, and learning resource centers on any of the College’s campuses.
SECTION 12. STUDENT CODE OF CONDUCT
- Dual credit students must comply with College policies and procedures as listed in the College Catalog: https://catalog.blinn.edu/
- Students must comply with the College’s academic regulations as it relates to faculty-student integrity and student responsibilities: here.
- If a student is alleged to have breached the College’s code of conduct or other policies, it is the student’s responsibility to follow the process. For specific questions or information about student conduct, please consult Board Policy, FLB.
SECTION 13. FUNDING AND PAYMENT
- Tuition and fee payment and procedures outlined in Section 6 are due from students as established by the College. Payment as described above remains due before the required due date; all tuition fees that must be paid when not being paid by the District or School must be paid in full by the student or parent/guardian at time of registration. Late payments may result in the student being dropped from the class roster.
- Financial Aid is not applicable to dual credit students. “The Higher Education Technical Amendments of 1987 (P.L. 100-50) states, “A student who is enrolled in an elementary or secondary school is not eligible for Title IV assistance for courses and the postsecondary level for the period of time TEA and THECB. The College may require a verification form for proof of compliance and location for courses (CFR 668.7(a)(1)(ii)).
SECTION 14. RECORDS AND REPORTING
- Class Rosters. The College will provide class rosters (listing the names and academic courses of enrolled dual credit students completing the course) at the close of each semester.
- Student Records; Record Retention; FERPA. In accordance with Applicable Law, each Party will maintain student records and as may be necessary or advisable to operate the Dual Credit Program; provide the other Party copies of the grades, progress, informational data on student progress and assessment, and information required to be provided to participate in the FAST program. Both Parties will be responsible for maintaining student records and records pertaining to the Dual Credit Program in conformity with the Texas Record Retention laws. Each Party shall institute policies and procedures to reasonably be ensured that its employees and agents comply with these and all federal and state laws governing the protection and disclosure of education records to students and their families. FERPA. The Party’s records must be protected in accordance with applicable and current education record retention policies, such as well as other applicable regulations and laws for public institutions of higher education.
- Transcription of Credit. For dual credit students, a high school as well as college credit should be transcripted for the completion of identified courses at the School/District’s option as per Texas Education Code Chapter 4, Subchapter D, §4.85(d) and College policy.
SECTION 16. TERM AND TERMINATION
- Term. The term of this Agreement shall commence upon the Party’s Effective Date (Agreement Date) and expire on the last day of the second to a term after Agreement execution (Expiration Date). Notwithstanding the foregoing, this Agreement may be extended for a term equal to the parties’ agreement, as stated by the Parties and approvals as may be required by the Parties’ governing boards. The time period shall be for the “Initial Term”. Upon mutual written agreement, this Agreement may be extended for a new term not to exceed the initial term.
- Termination. This Agreement may be terminated, with or without cause by either Party, upon such written notice of time not to later than sixty (60) days prior to the end of the current term such that the remaining students have already enrolled at the Dual Credit Program outline calendar for the same students being listed for dual credit classes for the next semester. Notwithstanding the foregoing, the notice required to effect the same those dates may be waived by the Parties’ respective agreement.
Governing Law; Venue; Any such modifications or amendments shall be in accordance and made pursuant to the laws of the State of Texas. Both Parties agree to the choice of law and for any actions under this Agreement, exclusive jurisdiction and venue of the courts of Washington County, Texas for any actions under this Agreement.
Notice: All notices hereunder permitted under this Agreement will be delivered (1) personally; (2) by certified or registered mail or real, return receipt requested; (3) by overnight courier; (4) by email or by either Party shall be in writing and delivered as follows:

- Assignment. Neither Party may assign its interest in the Agreement without the prior written consent of the other Party. Any such assignment made without such prior written consent shall be void.
- No Third Party Rights. This Agreement shall be solely for the benefit of the College and the District and their respective successors and permitted assigns. Nothing in this Agreement will be deemed or construed to create a relationship with the College and the District and any third persons, including a parent relationship in the nature of a third-party beneficiary or fiduciary.

CURRENT COLLEGE PROCEDURES FOR GRADING AND CREDIT
Grades
At the conclusion of their courses, students shall receive a final grade that shall become a part of their permanent record. The College’s grading system shall apply to all dual credit courses:

Interpretation of Grades
- Q - Dropped: assigned before or on the official "Q-Date" as indicated on the College calendar, when a student officially dropped before or on the last day to drop without penalty is considered dropped with a W.
- W - Dropped Due to Good Cause: assigned before or on the official "Q-Date" for reasons such as: severe illness, family emergency, death of a family member, military service, etc.
In repeated courses, the grade of W or Q shall be used in determining the cumulative grade average. A grade of “W” in College shall not replace a grade of “F” or higher in the highest grade of a repeated course shall replace in “determining” the Q.
The computation of student’s College GPA shall include a student’s transfer coursework point average (GPA), developmental coursework, if W, Q, NP, FS, and "Programs of Study" are treated as not included excepted grades of I. (See “Programs of Study” for degree requirements.)
If you have questions regarding grade changes, call the Vice Chancellor of Academic Affairs at (979) 830-4130. The student must initiate contact no later than the end of the next long semester (e.g. fall to spring, spring to fall, and summer to fall). If the value is justified and the chart below is used, the grade shall stand.
Academic Good Standing, Probation, and Suspension
A student who falls below a 2.0 cumulative grade point average (GPA) at the close of any long semester or summer school will be placed on scholastic probation. A student who returns to a 2.0 cumulative and cumulative GPA will be removed from scholastic probation. Students being placed on scholastic probation will receive an email with their Blinn College Box account. Students being placed on scholastic suspension will be mailed a letter at their permanent address on record with an explanation of their scholastic status.
Students transferring from another college with less than a 2.0 GPA will be admitted on scholastic probation. These students must meet the same requirements in subsequent semesters as all other students on scholastic probation at Blinn College.
Students who are on scholastic probation are not eligible to be a candidate for an election or benefits of office at a college-sponsored activity or group. This restriction does not apply if representation in the activity or organization is part of the requirements for a course or program. A student who is on scholastic probation may be ineligible for college scholarships, ineligible to represent the College, and may be subject to a loss of veteran’s or appointed office during and at an award on scholastic probation is part of the requirements for a course or program that requires a role to keep the user.
A student placed on scholastic suspension will not be allowed to attend the College for one long (spring) semester. At the conclusion of this suspended semester, the student can reenter the College and will be placed back on scholastic probation.
For those students who have been scholastically suspended but have extenuating circumstances preventing their return while failing to meet the minimum 2.0 GPA, an appeal for reinstatement may be made. This appeal must be made in writing to the scholastic appeals committee. Information on the appeal procedure and deadline is included in the letter sent to suspended students. The decision of the scholastic appeals committee is final. An appeal for reinstatement may be made by the student or a family member. If required, a student must show approval for reinstatement of financial aid funds.
