WHEREAS, the Texas Education Code (TEC) §§ 28.009, 29.182, 29.184, and 130.008; and 19 Texas Administrative Code (TAC) Chapter 4, Subchapter D and Chapter S, Subchapter H authorize an institution of higher education to enter into an agreement with a public school district for the provision of instruction facilitating dual credit as a credit toward both high school and college; and
WHEREAS, the College and the District desire to establish a dual credit program (Dual Credit Program) to be carried out as set forth in the District’s school district;
NOW THEREFORE, for the mutual promises and covenants described herein and other good and valuable consideration, the Parties agree as follows:
SECTION 1. GENERAL CRITERIA
A. Blinn College District (College)
- The College will designate a leadership team to continue as a bridge to the college experience and serve as the foundation for the Dual Credit Program.
- The management service area includes the following birth towns: Austin, Brazos, Burleson, Fayette, Grimes, Lee, Madison, Walker and Washington Counties and parts of Milam, Montgomery, Robertson and Walker Counties.
- The college will ensure that dual credit courses follow the same quality, sequencing, content, and rigor as those courses taught on the institution's other sites. Blinn ensures that all credit courses comply with the Southern Association of Colleges (SACSCOC) standard.
- The college will evaluate dual credit courses to ensure that content is consistent with the educational purpose, mission, and goals of the College and shall be under the direct control of the College. Developmental courses are not available to dual credit students. Kinesiology courses that count towards the high school graduation physical education requirement are not offered to dual credit students.
- Dual credit courses may be offered during any semester in a location and classroom mutually agreed upon by the School and College. The College will seek every opportunity to use the available technology as appropriate to support dual credit sites.
- The District is responsible for ensuring that dual credit courses meet the Texas Essential Knowledge and Skills (TEKS) requirements. A course equivalency crosswalk will be used to align high school courses with college courses. Such crosswalk identifies the number of credits that may be earned for each course delivered through the Dual Credit Program. It will also allow the alignment of endorsements offered by the District and recommendations by the institution and career readiness strategies for the School. Each participating district will approve all dual credit courses that may be offered under this agreement and identify the associated high school graduation pathways and credentials at the credit assignment, based on recommendations, that each course leads to and the associated number of credits. See Appendix F: Dual Credit Course Crosswalk.
- Dual credit students will have equitable access to course and support facilities comparable to the ones offered on the College campus, regardless of modality of instruction.
- The School will provide instructional technology and other auxiliary equipment typically used in support of classroom instruction.
- The School will provide facilities, personnel, and equipment to meet the particular requirements for the online/internet, Interactive Video Conference (IVC). Appendix B describes video class regulations.
- The School will assign professional-level personnel, as applicable and as agreed upon between the Parties, who will be responsible for identifying, advising, and verifying prospective student(s) eligibility to participate in the Dual Credit Program in accordance with Applicable Law.
- The School will assign trained professional-level personnel, as applicable and as agreed upon between the Parties, to assist with College recommendations, guidance services, and other student counseling.
- The School will initiate the process to provide accommodations due to a disability by providing students and parents information regarding appropriate documentation for submission to the College’s Office of Disability Legal Plan (IEP). It is the responsibility of the parent or guardian to initiate and follow up with the College's Office of Disability Services (ODS) for the College.
- Upon receipt of the School/District IEP documentation submitted by the student, the College's ODS will review the documentation for reasonable accommodations. Whenever possible, accommodations shall be provided at either the high school or college site unless otherwise deemed necessary by the College. For more information and to access a student handbook or request additional information, please contact the College’s ODS.
- Although a student may pass a College class with a grade of D, the District/School will be responsible for communicating to students and parents that under 19 TAC § 74.26(c), credit for courses for high school graduation may be earned only if the student received a grade which is the equivalent of 70 on a scale of 100. College personnel will not be expected to communicate with parents. See Appendix A.
- Dual credit students are not affected by the provisions of TEC §51.907. Therefore, dual credit students with Q drops will be recorded as a W and will not be penalized as one of the allowed six-state-drops.
C. Applicable Law
- The Parties agree to operate the Dual Credit Program and perform their obligations hereunder and collaborate consistent with the applicable federal, State, and local laws, implementing regulations, executive interpretive rulings, and administrative rules and regulations, as amended from time to time. Such laws include but are not limited to, and procedures adopted to ensure the purpose of each statute is being met, as may be amended:
- Title VI of the Civil Rights Act; Title IX of the Civil Rights Act; Title IX of the Education Amendments of 1974; Section 504 of the Rehabilitation Act of 1973; the Age Discrimination Act of 1975; Americans with Disabilities Act of 1990; Family Educational Rights and Privacy Act (“FERPA”)
- Title II of the Carl D. Perkins Career and Technical Education Improvement Act of 2006; Title I, Higher Education Act of 1965, as amended; Tex. Admin. Code, Title 19, Part 1, Chap. 4, Subchapter D; 19 TAC Chapter 9; the Texas General Appropriations Act; Chapter 28 of the Texas Education Code; and other laws, rules, and policies
- To comply with all policies of the Family Educational Rights and Privacy Act, 20 U.S.C. §1232g:
- a. In all cases, to comply with all federal, state, and local laws relating to the education and care and abide by policy prohibiting unlawful discrimination based on sex, sexual orientation, gender identity, race, ethnicity, age, and disability, in any other protected class, and
- b. To uphold and abide by policy prohibiting the disclosure of protected student information.

SECTION 2. DUAL CREDIT ADMISSION - STUDENT'S REQUIRED ACTIONS
A. Students may attend the College during the semester in which the student demonstrates readiness for college-level course(s) or otherwise is eligible in accordance with Applicable Law. The following requirements for admission must be met:
- Obtaining written or electronic permission from the high school principal or the principal's designee, as set forth in Appendix C.
- Earning a "B" or better average (or the equivalent numeric average of "C" for WECM trades courses - if the student has a lower average, then that is the grade the student earns in their final high school principal or the principal’s designee except where the school allows for higher cuts in the course; otherwise the student should allow for a higher cut in the course.)
- Completing a College Application for admission through ApplyTexas.
- Meeting the following requirements of Applicable Law:
- a. Have satisfied current TSI criteria for dual credit that are determined by the THECB. Score requirements, on waiver basis must be furnished by the District/School or the student on all official dual enrollment prior to registration. For eligibility scores and exemptions available on the College’s website, https://www.blinn.edu/dual-credit/eligibilityrequirements.html.
B. Students who are enrolled in private or non-accredited secondary schools, or who are homeschooled must meet all admission requirements set forth in this Agreement.
SECTION 3. CLASSES AND SCHEDULES
A. Prior to the start of each semester, the College will coordinate and finalize the proposed course schedule with the School in a timely manner. To facilitate meeting College faculty and course scheduling deadlines, the School will submit the anticipated number of students per course section for the next school year by May 1st prior to the beginning of that school term. The School must submit the proposed course schedule for the next school year by 20th prior to the beginning of that school term.
B. All high school students enrolled in a College academic dual credit class will follow the course schedule established by the College, unless extenuating circumstances, as determined by the Divisional Dean.
C. A high minimum number of students in a dual credit course section will be required. The College will collaborate with the District to determine the minimum course size per course section and the allocation of seats available by School facility or site number will be required. The Parties agree that the minimum number of students for a dual credit course in which the instructor is to provide face-to-face instruction may be composed of students from the District/School as well as one or more other school districts or education institutions. If there are fewer than the minimum number of students required, the Office of Dual Credit Programs will confer with the District's dual credit representative to explore instructional alternatives. The College will not be responsible for and will not provide transportation.
F. If the College provides flexible class scheduling at the School facility, as determined by the Divisional Dean.
SECTION 4. FACULTY
- Per SACSCOC accreditation guidelines, dual credit courses are offered in adequate physical facilities, whether under dual credit or otherwise on the School site or the School. The College will assess the facility prior to the beginning of instruction and periodically review classroom needs and suitability.
- College and District/School representatives at each site meet as needed, and as needed, to assess, and select the instructional modality.
SECTION 6. FINANCIAL AID FOR SWIFT TRANSFER (FAST) PROGRAM
The state of Texas has created the Financial Aid for Swift Transfer (FAST) program which provides funding to colleges so they can offer dual credit courses to eligible economically disadvantaged students at no cost to these students. The Texas Education Code (TEC) defines “educationally disadvantaged” as those students eligible for the national free/reduced price lunch program. These students are referred to as FAST-eligible students.
Students are “eligible/educationally disadvantaged” under the FAST program if they (1) are enrolled in an eligible dual credit course as a public school student at any high school and (2) qualify for free/reduced-price lunch in any of the four school years before enrolling in the dual credit course. It is also the student or the parent/guardian that FAST-eligible students at participating institutions incur no cost for dual credit courses but must provide a FAST eligibility audit.
Dual Credit Courses eligible for FAST must include your tuition fees under either TEC, Section 130.008, Courses for Joint High School and Junior College Credit, or the course identified in Chapter 51, Subchapter D, Rules 61.1-8, as school board authorized by consent (e.g., a certificate, associate degree for which a high school could be required to consent). By statute, the course must also satisfy at least one of the following:
- Required necessary to obtain an associate degree or an industry-recognized credential or certificate (using the endorsement of an industry-recognized credential or certificate that is established for that area of study at the college level).
- A foreign language requirement by an institution of higher education.
Students are eligible to enroll at no cost in a dual credit course under the FAST program if the student meets each of the following:
- Is enrolled in high school in a school district; or
- Is enrolled in a dual credit course at a participating institution of higher education; and
- Was educationally disadvantaged at any time during the four school years preceding the student’s enrollment in the dual credit course covered for the current academic year.
The Parties will work together to verify FAST eligibility for each student enrolling in the Dual Credit Program. Non-FAST eligible students enrolled in dual credit courses, the student will be charged $56.87 per academic semester credit hour or the State of Texas approved tuition rate for the current academic year.
The Parties will work together to develop and provide information to students and their families about the FAST program.
SECTION 7. TUITION
- Students enrolled in dual credit courses under the Dual Credit Program will pay tuition and fees. Dual credit tuition costs will be charged using one of the option(s) below:
Dual Credit: A discounted and approved instructor employed by the District is utilized for teaching (WECM) dual credit course and the course per hour tuition for each student enrolled in the student enters the course. *During the term as the student for a college technical division agreement, the credit is NOT less than for each course but is subject to change as established by the College’s Board of Trustees or the State of Texas.
SECTION 8. COLLEGE FACULTY COMPENSATION
A. Full-time College faculty members who teach dual credit courses, the course syllabi and texts for the course.
B. College syllabi, curriculum, supplies, and resources, and testing books in accordance with the board curriculum.
A. A college Common Syllabus must be posted in SACSCOC for each dual credit course that College policies and state outcomes of master course syllabi including texts, Internet college courses, course outcomes, materials, as required.
- Dual Credit courses will contain an equivalent of the textbook, course syllabus including, but not limited to, the same elements of master course syllabi and course outcomes, including policies and instructors' outcomes as well as a course calendar.
SECTION 10. LIBRARY AND LEARNING RESOURCES
Dual credit students and instructors may use the library resources offered by the School or any of the College Campuses. Students also have access to the College library resources. Dual credit instructors may borrow from students and instructors who are part of the Dual Credit Program are limited to those provided at a College or by the College.
SECTION 11. ACADEMIC ADVISING AND STUDENT SUPPORT SERVICES
- The College will provide adequate instructional support services, including advising and testing accommodations to meet the needs of dual credit students. These services include:
- assigning an academic advisor to the student population and advising all teaching requirements of TX SB 1277 (2021), including but not limited to designating at least one employee within each participating high school who will advise or meet students enrolled or who desire to enroll before beginning the course. Appendix G establishes common advising strategies for enrolling dual credit and college readiness.
- In active collaboration with the College, the District coordinates and assists with the advising meetings delineated in Texas SB 25 (2019) (and TX SB 1324 (2019)), including the annual processes public and private meetings, updated, timely matchup scheduling, including the filing of degree plans at credential completion and the publication of course sequences.
B. Support Services
Dual credit students may use the computer labs, writing centers, and learning centers on any of the College's campuses.
SECTION 12. STUDENT CODE OF CONDUCT
- Dual credit students must comply with College's academic regulations as it relates to academic integrity. (College Student Code of Conduct)
- Students must comply with the College regulations as outlined in the College Catalog. For more information: in civility protocol, please consult Board Policy, FLB.
SECTION 13. FUNDING AND PAYMENT
Tuition and fee payments in the amounts set forth in Section 6 are due from the College in accordance with the payment process set forth in subsequent paragraphs. A payment plan is available.
The College is not responsible for the transportation of dual credit students.
SECTION 14. RECORDS AND REPORTING
- Class Rosters. The College will provide class rosters (listing the names and unique identification number of all dual credit students completing the course) in a numerical format of dual credit students completing the course as requested by the District.
- Student Records; Record; FERPA. In accordance with the laws and Applicable Law, each Party will maintain student records in its own files, as necessary to operate the Dual Credit Program; provided that the other Party or copies of the grades, progress, information and documentation will be made reasonably available to the other Party sufficiently timely to participate in the FAST program. Both Parties will be responsible for maintaining student records and files relating to the Dual Credit Program including but not limited to class rosters and record information. Each Party retains and maintains primary responsibility for ensuring that it is in compliance with any laws and regulations with respect to records maintained by each respective educational agency, and the record of students who have been reported as unauthorized withdrawals or dropouts, and who have been otherwise counted as educational records and unauthorized withdrawals.
- Transcript of Credit. For dual credit courses, high school as well as college credit should be transcripted immediately upon a student’s completion of the course and successful demonstration of course progress. [TAC 19, Part 1, Chapter 4, Subchapter D, Section 4.85]
SECTION 15. CONFLICT RESOLUTION
The Parties agree to resolve issues that may arise in the course of their relationship and shall act in accordance with applicable laws and contract requirements. Each problem should be first raised by the site staff to implementation in the manner outlined below:
- Each Party shall notify the other, in writing and in a timely manner, of complaints or concerns it has regarding its implementation. The response by the District/school should include a statement of the steps being specifically to provide a quality dual credit program while also maintaining accreditation.
SECTION 16. TERM AND TERMINATION
- Term. The program as described herein shall commence upon the Effective Date (and commence at a date after all contracts and forms are duly signed for the semester of 2027 after Expiration Date). Notwithstanding the foregoing, both Parties acknowledge and agree that this Agreement shall continue in effect during the Term as provided herein unless terminated by the Parties in accordance with the provisions herein. Upon renewal, the written agreement by the Parties may be terminated by a "Term" Statement. The initial Term/annual Term shall be set forth in the Agreement for a minimum of 1 year or the period provided for as the period by statute or by which the Parties agree and must be set forth subject to the terms herein.
- Termination. (Direct; Removal Under the terms of this Agreement, either Party upon notice may terminate this agreement without cause by delivering written notice thirty (30) days prior to the end of the current agreement or upon the last day of the school year by the College unless otherwise agreed in writing. Notwithstanding the foregoing, the dual credit classes which are in session at the time notice is delivered hereunder shall conclude their term.
B. Amendments
- This Agreement may be modified and amended only by written signatures of both Parties; and new rights and obligations shall be attached and become a part of this Agreement, by enforcements.
- Governing Law; Venue: This Agreement and the rights and obligations herein shall be governed in accordance with, and construed in accordance with, the laws of the State of Texas without regard to its choice of law or conflict of law provisions. The courts of Washington County, Texas for any action under this Agreement.
- Notice. All notices hereunder or either Party shall be in writing and delivered (1) personally; (2) by courier or recognized national or international delivery service; (3) by certified or registered United States mail, return receipt requested; (4) by overnight mail; or (5) by facsimile or other electronic means when issued by original overnight, deemed permitted under the Texas Business and Commerce Act. Such notice shall become effective immediately upon specific receipt or upon referral when received as addressed as follows:

E. No Waiver.
No waiver of or failure by a Party in exercising any right, power or privilege, hereunder or otherwise or any other instruments given in writing by the other Party shall be effective unless in a written instrument, right, power or privilege or be construed as a waiver thereof or acquiescence in any default. No single or partial exercise of any right, power, or privilege, hereunder or otherwise, precludes any other or further exercise of right, power, or privilege. By their execution of the Agreement, neither Party waives any right to which that Party may be held for the activities out of this Agreement.
F. Assignment
Neither Party may assign any interest in the Agreement without written permission of the other Party. Any such assignment shall be void without prior written agreement.
G. Captions
The captions contained herein are inserted for reference only and in no way limit the terms and provisions of the Agreement.

CURRENT COLLEGE PROCEDURES FOR GRADING AND CREDIT
The Board shall establish the manner by which grades shall be determined and credit shall be awarded. These provisions shall include the methods for grading student grades, the calculation of a student’s grade averages (GPA), the classification of honor graduates, grade point procedures, the transfer of credits, student standards of performance, special award procedures, and any other relevant matters. The provisions established in the Board for College implement the grading and credit provisions adopted by the Board. [For class rank calculations and honors determinations, see EGB]
Grades
At the end of each semester students shall receive a final grade report that shall become a part of their permanent record. The College’s grading system shall apply to all courses:
- A (90-100) - Excellent
- B (80-89) - Good
- C (70-79) - Average
- D (60-69) - Poor (Below 60) - Failure
- I - Incomplete
- Q - Dropped
- W - Dropped Due to Good Cause
- CR - Credit
- P - Pass
- NP - Not Passing
- FS - Academic Fresh Start
Q - Dropped: assigned before or on the official "Q-Date" as indicated on the College calendar when a student has officially withdrawn from the course.
A "Q" may also be given after the "Q-Date" if the student is passing the course at the time the official drop is processed.
W - Dropped Due to Good Cause: assigned before or on the official "Q-Date" as indicated on the College calendar when the student has officially withdrawn from the course.
- A severe illness or other debilitating condition that affects the student's ability to satisfactorily complete a course;
- The death of a person who has a sufficiently close relationship to the student;
- The care of a sick, injured, or needy person if providing that care affects the student’s ability to satisfactorily complete a course; close relationship to the student;
- The student’s military service;
- A change in the student’s work schedule that is beyond the student’s control and affects the student’s ability to satisfactorily complete a course. The highest grade of a repeated course shall be used in determining the cumulative grade point average. A grade of "F" shall replace a grade of "W" or "Q".
In a repeated course, but a grade of "F" shall replace a grade of "W" or "Q" in the repeated course, but a grade of "W" or "Q" shall not replace a grade of "F."
The computation of a student's College Graduation GPA shall include, but is not limited to, all college credit hours, except coursework of I, W, Q, NP, P, FS, and Programs of Study for detailed information available.
Grade changes: The deadline for grade changes, call to the Vice Chancellor of Academic Affairs at (979) 830-4100. The student must initiate contact no later than the end of the next long semester (regarding spring, fall to spring, and failure to file).
Scholastic Probation and Suspension
A student who falls below a 2.0 cumulative grade point average (GPA) at the close of any long semester or summer school will be placed on scholastic probation. A student will remain on probation until he/she has earned a 2.0 semester and cumulative GPA at the end of subsequent semesters will be placed on scholastic probation. A student with a semester GPA of less than 2.0 and a cumulative GPA of less than 2.0 will remain on scholastic probation. Students placed on probation must meet the same requirements in all their Blinn College Buc account.
Students transferring from another college with less than a 2.0 GPA, if admitted, are admitted on scholastic probation. These students must average the same GPA requirement when transferring.
A student placed on scholastic probation becomes ineligible to be a candidate for an elective or appointive office of a college-sponsored activity or organization. This restriction does not apply to students on academic probation if being part of the requirements of college policy. A student who is placed on scholastic probation because of their probationary status, he or she may be subject to a loss of privileges and/or benefits of participation. Aid and student registration prior to registration will be denied for students on scholastic probation not eligible to register for future terms unless they are placed on probation in the next term for which the probation policy applies.
A student placed on scholastic probation may reenter but will not be allowed to attend the College for one long semester (fall, spring, or combined summer term). After the period of suspension, the student may reapply for admission. No credit for courses taken at another college during the period of suspension may be applied to satisfy Blinn College degree requirements. If readmitted, a student must make a separate appeal for reinstatement of financial aid.

Notice of Reimbursement of Services
ABC ISD agrees to provide the following for credentialed high school faculty member(s), and __________ to teach a College Dual Credit class.
- The dual credit students in this class will be charged for fees according to the Agreement between the College and the District.
- ABC ISD agrees that the reimbursement will be required to have a minimum of __ students in order to make ABC ISD $500.00 for the services rendered by the teachers listed above who has been approved for credentials to teach a Dual Credit Class.
- The College will submit the reimbursement and services to the District at the end of each long semester.
