This Agreement for the Blinn College District Dual Credit Program (Agreement) is by and between BLINN COLLEGE DISTRICT, a public community college established under Chapter 130 of the Texas Education Code and a political subdivision of the State of Texas, (College), and:

College Station ISD

a Texas Public independent school district and political subdivision of the State of Texas, (District) with an effective date of June 1, 2024 (Effective Date). Individually, the College and the District are referred to herein as “Party” and collectively as “Parties.”

RECITALS

  • WHEREAS, Texas Education Code (TEC) §§ 28.009, 29.182, 29.184, and 130.008, and 19 Texas Administrative Code (TAC) Chapters 4, Subchapter D and Chapter 9, Subchapter H authorize an institution of higher education to partner with a public school district for the provision of instructional opportunities, including the delivery of courses for dual credit.
  • WHEREAS, the intent of the Parties and desire is to establish a dual credit program (Dual Credit Program) to be operated as further described in this Agreement.

NOW, THEREFORE, the Parties, for and in consideration of the mutual covenants and agreements contained herein, hereby agree as follows:

SECTION 1. RESPONSIBILITIES OF PARTIES

A. Blinn College District

  1. The College is the legal entity authorized to:
    • Provide postsecondary courses/content agreed upon in the Dual Credit Crosswalk (Appendix D) to the students of the District/School (students) for delivery as part of the Dual Credit Program; and
    • Approve and maintain, in collaboration with the District/School, a current listing of dual credit courses (Appendix D).
  2. The College will assign a program administrator with the responsibility for ensuring the delivery and effectiveness of the Dual Credit Program, as well as compliance with federal, state, and local laws and regulations.
  3. The College will provide qualified instructors who meet the requirements for all faculty, including dual credit courses, in compliance with the policy of the College and all applicable accreditation and state requirements.
  4. In accordance with Applicable Law (as hereinafter defined), the College will offer dual credit courses listed in the current edition of the Texas Higher Education Coordinating Board’s (THECB) Lower Division Academic Course Guide Manual (ACGM) and Workforce Education Course Manual (WECM). Courses offered in each semester shall be determined by the College and agreed upon by the District/School. Courses provided by the College under the Dual Credit Agreement shall be consistent with the educational purpose, mission, and goals of the College and should not exceed the credit hour count of the College. Developmental courses are not available to dual credit students. Kinesiology courses that count towards the high school physical education graduation requirement will not be offered for dual credit.
  5. Dual credit courses may be offered during any semester in a location and classroom mutually acceptable to Parties. Students of the District/School will be given every opportunity to use the available technology as appropriate to support dual credit studies.
  6. The District is responsible for ensuring that dual credit courses meet the Texas Essential Knowledge and Skills (TEKS) requirements as a college course. Such crosswalk will be used to equate high school coursework as college coursework. The Crosswalk will list all applicable courses by both agencies and the Texas Education Agency course number as mutually approved. The Crosswalk must be made available and updated as needed by the District and College (Appendix D).
  7. The College will provide information for student registration, enrollment, and withdrawal for dual credit courses and ensure compliance with FERPA and other privacy laws in communication with parents.
  8. The College will post and communicate all relevant and current policies and requirements as applicable for the Dual Credit Program as found on the college website, student handbooks, and dual credit announcements.
  9. The College reserves the right to cancel the course(s) as necessary.
  10. The College strongly encourages dual credit students taking classes online to have an in-school time scheduled to work with a high school proctor.

B. The School

  1. The School is responsible for providing a learning atmosphere and classroom facilities comparable to the ones offered on the College campus, regardless of modality of instruction.
  2. The School will provide instructional technology and other auxiliary equipment typically used in support of classroom instruction.
  3. The School will provide facilities, personnel, and equipment to meet the particular requirements for the courses, including Internet, Interactive Video Conference (IVC). Appendix B describes video access requirements.
  4. The School will assign professional-level personnel, as applicable and as agreed upon between the Parties, who will be responsible for identifying, advising, and vetting prospective students’ eligibility to participate in the Dual Credit Program in accordance with Applicable Law.
  5. The School/District will be responsible for the cost of necessary student accommodations as required by the Parties, to assist with compliance with Section 504 of the Rehabilitation Act of 1973, along with other Unified School District requirements. It is the District’s/School’s responsibility to provide the necessary documentation to Blinn College for those students with a current and active IEP (IDEA or 504 Plan) requiring accommodations. It is the responsibility of the student and the parents (or guardians) to provide their IEP documentation directly to the College. Information shared will be kept confidential and used only to provide needed accommodations (Section 504 of the Rehabilitation Act and the Americans with Disabilities Act). For additional information, refer to the Blinn College Website for Accommodations.
  1. Whereas the College will follow existing Board of Trustees policies with regard to assigning a grade for College credit in the dual credit courses, if the College grading scale differs from the District’s grading scale, the District/School will provide participating students with a comparative document displaying both the College grading scale and the District’s grading scale. See Appendix A.
  2. Although a student may pass a College class with a grade of “D”, the District/School will be responsible for communicating to students and parents that under 19 TAC § 74.26(c), credit for two high school graduation may be earned only if the student received a grade which is the equivalent of 70 on a scale of 100. College students with a “D” will not receive high school credit. See Appendix A.
  3. Dual credit students are not affected by the provisions of TEC §51.907. Therefore, dual credit students with D drops will be recorded as a W and will not subject to this rule.

For purposes of this section, the Agreement and all other applicable laws referenced in sections 1.C and any other laws, rules, and guidelines relating to the subject matter of this Agreement collectively shall be referred to as “Applicable Law” or “Applicable Laws” when used herein.

SECTION 2. DUAL CREDIT ADMISSION – STUDENTS’ REQUIRED ACTIONS

A. Students may attend the College during the semester in which the student completes all requirements for dual credit enrollment or otherwise is eligible in accordance with Applicable Law. The following requirements for admission include:

  1. Obtaining written or electronic approval from the high school principal or other designated District/School official or staff designee, who will assess eligibility and compliance for the Dual Credit Program from the District/School perspective, including the following:
    • Verification of all eligibility requirements for the Dual Credit Program and the College. See Appendix B for forms.
    • Verification that the student meets all College and high school requirements for entry and participation in the Dual Credit Program and for the particular course.
  2. Proof of Bacterial Meningitis Vaccine. Students must provide to the College Enrollment Services Office a certificate signed by a health practitioner indicating they have been vaccinated against bacterial meningitis. This requirement does not apply for students enrolled in the Dual Credit Program who will take classes exclusively at a School facility, or for complete online students. Dual credit students taking classes in-person on any Blinn College campus must provide proof of the vaccination as required. Refer to http://www.blinn.edu/immunization.html for detailed information regarding bacterial meningitis.

B. Students who are enrolled in private or non-accredited secondary schools, or who are homeschooled must meet all admission requirements set forth by the College.

SECTION 3. CLASSES AND SCHEDULES

  1. Prior to the start of each semester, the College will coordinate with the District/School to provide opportunities for the student to build a class schedule in a timely manner. To facilitate meeting College deadlines, the District will submit the names of all eligible students and the classes they wish to take for each semester of the year. The College will provide access to its registration process as specified for the program/participation. Any schedule changes must be approved pursuant to the District/School’s and College’s procedures and must comply with deadlines and requirements for C/NC, drop/add, etc.
  2. If an approved class cannot be held at the scheduled time, the District/School is responsible for notifying the College in writing within five (5) business days of the start of the semester, and each Party will cooperate to implement an alternative solution, if possible. This includes notifying the College of an ineligible, dropped, or withdrawn student.
  3. For dual credit courses, the District/School and the College will collaborate to ensure all students meet the appropriate prerequisites/co-requisites for the course(s) prior to enrollment. Dual credit courses may be taught in face-to-face, blended/hybrid, or online formats.
  4. If a course designated as dual credit is being offered as an articulated course, the dual credit class can include a combination of technical dual credit students, college credit students, and/or local articulation students.
  5. In order for the College to provide face-to-face instruction for an academic dual credit course on the School’s or another high school campus, the campus must be within a reasonable commuting distance from a College campus, a minimum class size number will be enforced. The Parties agree that the minimum number of students for a dual credit course in which the instructor is to provide face-to-face instruction on the School’s campus must be agreed upon by the District/School as well as one or both other sites or educational institutions. If there are fewer than the minimum number of students required, the Office of Dual Credit Programs will confer with the District’s and central office personnel to explore instructional alternatives. The College will not be responsible for and will not provide transportation.
  6. If the College provides face-to-face instruction on the School’s campus, students may not take the same course online, except with prior written approval, referencing the Divisional Dean.

SECTION 4. FACULTY

  1. The faculty assigned to College dual credit courses must meet the requirements for credentialing guidelines posted by the College. The College may accept instructor credentials used by the District/School upon confirmation that state and agency minimum requirements are met. Approval rests with the College. Faculty must follow the professional code of conduct, including working hours that are both applicable and commensurate with the workload as determined by the College and/or the Departmental Office, in compliance with standards for similar college classes. See Section 8 for faculty compensation.
  2. Dual credit faculty are considered College faculty. Employment status and compensation will be determined as specified in the addendum or attachment. See Section 4.B for additional clarification.

Section 4.B. does not alter that employment status of any Party’s personnel, create liability for either Applicant, or permit the inclusion of an employee of either the College or the District to comply with the policies of that employee’s employer.

SECTION 5. FACILITIES

  1. Per SACSCOC accreditation guidelines, dual credit courses are offered in adequate physical facilities, whether under the control of the College or under the control of the School. The College will assess the facility prior to the beginning of instruction and periodically review facilities as necessary.
  2. College and District/School representatives at each site will assess the facilities, determine the class size, and select the instructional modality.

SECTION 6. FINANCIAL AID FOR SWIFT TRANSFER (FAST) PROGRAM

The State of Texas has created the Financial Aid for Swift Transfer (FAST) Program, which provides funding to colleges so they can offer dual credit courses to educationally disadvantaged students at no cost to these students. The Texas Higher Education Code (TEC) defines “educationally disadvantaged student” as those students eligible for the national free/reduced price lunch program, or whose family has a household income at or below 185% of the federal poverty guidelines.

Students are “eligible students” under the FAST program if they:

  • Are eligible for the national free or reduced-price lunch program (or an allowed federal equivalent), or have a family household income at or below 185% of the federal poverty guidelines;
  • Are enrolled in high school in a school district or charter school;
  • Are enrolled in a dual credit course at the dual credit provider; and
  • Meet any one of these criteria:
    • Demonstrated college readiness through the TSIA2 or other applicable assessment or qualifying exemption;
    • A field of study requirement;
    • A core curriculum requirement.

Eligibility for the FAST program is determined by the Texas Higher Education Coordinating Board (THECB). Each semester, the College is required to submit a roster of dual credit students to THECB for verification of FAST eligibility. In order for them to be listed on this roster, the District/School agrees to identify and certify to the College the students who are eligible for the FAST program. This verification shall occur by August 5th, unless otherwise agreed.

Students will not be assessed tuition or fees for dual credit courses under the FAST program if:

  1. The student is eligible under the FAST program (see above); and
  2. The student is enrolled in a dual credit course at the dual credit provider described herein.

Participating in the FAST program requires that students and dual credit eligible students work together to verify eligibility under the criteria and dual credit crosswalk published and produced as a part of this Agreement.

If the instructor of a dual credit course is not a College faculty member employed by Blinn College, then the FAST program does not cover the amount paid to the instructor for instruction in that dual credit course. This applies to both ACGM and WECM courses. In such cases, the College and District/School may decide, as appropriate and in accordance with state regulations, on a tuition reimbursement procedure. If instructional costs exceed that covered by FAST, the student will pay the State of Texas approved tuition rate for the current academic year.

Option 1: IF, an instructor who is a College (or District employee) provides dual credit instruction for a class that is under the FAST program, THEN, a NON-FAST student enrolled in the Dual Credit Program will pay the State of Texas approved tuition rate for the current academic year.

Option 2: IF, a qualified and approved instructor not employed by the District is utilized for a course and the College does not receive a tuition reimbursement for the qualifying instructor rate; THEN, a NON-FAST student enrolled in the Dual Credit Program will pay the State of Texas approved tuition rate for the current academic year.

Option 3: IF, a qualified and approved instructor employed by the District is utilized for a technical (WECM) dual credit course and the College owes compensation to the instructor THEN, the District will receive a reimbursement of service payment of $500 for each course section added dual credit. A minimum of eight (8) for four (4) credit hour sections on high school campus as the instructor minimum.

*During the Term (as hereinafter described) of this Agreement, the credit hour tuition per semester will not be increased unless authorized by the College’s Board of Trustees or the State of Texas.

SECTION 8. COLLEGE FACULTY COMPENSATION

  1. Full-time College faculty member assigned to dual credit course at School site.
  2. Blinn College adjunct instructor assigned to dual credit course.
  3. School/ District compensated instructor (see Section 6. Finances).

SECTION 9. SYLLABUS, CURRICULUM, STUDENT MATERIALS

  1. The College requires a current and complete official Syllabus for each dual credit course, a copy of which will be provided to the instructor and maintained in College files. The Syllabus must align to the description and requirements found in the ACGM (academic) and WECM (technical) course guide manuals as referenced in Applicable Law.
  2. College instructors will use College-adopted curriculum and instructional resources for dual credit courses in a manner that is consistent with the College’s standards and instructional design.
  3. Dual Credit courses will use identical or equivalent textbooks, resources, or course content. The College is not responsible for providing textbooks to dual credit students. As per HB 3650 (87th Legislature, 2019), the District/School and the College will consider utilization of free or low-cost OER, or open educational resources as available for use. These resources will be reviewed periodically and collaboratively by academic personnel from the College and District/School.

As of August 2024, the College is an active participant in the Financial Aid for Swift Transfer (FAST) program. Students that are not eligible for Financial Aid for Swift Transfer (FAST) funds will be responsible for purchasing any required textbooks or additional resources required for the class(es). Students identified as FAST-eligible may obtain the list of required textbooks or additional resources required for the class(es). Cost of books and additional resources will be provided by the College.

SECTION 10. LIBRARY AND LEARNING RESOURCES

Dual credit students and instructors may use the library resources offered by the library of any of the College campuses. Students are also advised to use the College's online library resources. Circulation privileges and online instructional resources for students and instructors who are part of the Dual Credit Program are intended to be provided to all College district students.

SECTION 11. ACADEMIC ADVISING AND STUDENT SUPPORT SERVICES

  1. The College will provide adequate instructional support for dual credit students. Students receive individual assistance from academic advisors, the Learning Center, Writing Center, Disability Services, Computer Labs, the Testing Center, and College specialists. Information about these services and programs will be provided to high school students and their families.
  2. The College will develop and provide support materials about dual credit admissions, financial aid, registration and academic milestones and processes that are specific for financial aid and dual credit students.
  3. The designated academic advising contact for dual credit for the College is:
    Shannon Williford
    Director, Dual Credit Programs
    979-209-8218
    shannon.williford@blinn.edu
  4. Support Services—Dual credit students may use the computer labs, writing centers, and learning centers on any of the College’s campuses.

SECTION 12. STUDENT CODE OF CONDUCT

  1. All dual credit students must comply with College policies and procedures including, the Student Code of Conduct as outlined in the College Catalog: http://catalog.blinn.edu
  2. Students must comply with the College’s academic regulations as it relates to academic integrity.
    • If a student wishes to leave the classroom because of uncivil behavior, the student may not return to that class until that certain behavior is resolved according to College Policy. It is the student’s responsibility to arrange for this conference. If the instructor is not assigned at the student’s school, students must follow College Policy, FLB.

SECTION 13. FUNDING AND PAYMENT

  1. Tuition and fee payments in the amounts set forth in Section 6 are due from the student as invoiced and subject to any available local support. Payment may be made by credit card, check, cash, or as fees paid in agreement. Payment is due as specified in each College semester. Failure to pay tuition, fees, or other charges may result in withdrawal from the Dual Credit Program.
  2. Students enrolled in dual credit courses who withdraw before Census Date will be dropped from the class and refunded tuition and fees. If a student withdraws after the Census Date, the student will remain responsible for the full tuition and fees for the course.
  3. If a student requests to take a class more than twice, he or she will be responsible for the tuition for that course and $50.00 per semester hour for the course. Technical courses and FAST-eligible students are exempted from this fee. (see Blinn College Catalog – College Expenses)
  4. The College is not responsible for the transportation of dual credit students.

SECTION 14. RECORDS AND REPORTING

  1. Class Rosters. The College will provide class rosters (listing the names and grades in a numerical format of dual credit students completing the course) to the School at the close of each semester.
  2. Student Records; Record Retention; FERPA. In accordance with Applicable Law, each Party will maintain official records and data as necessary to operate and operate the Dual Credit Program; provide the necessary State reporting/statistical purposes, informational data on student progress and participation in the program; and make all records available to participate in the FAST program. Both Parties will be responsible for maintaining and ensuring the confidentiality of all educational records of participating students in compliance with FERPA, the Texas Open Records Act, the Texas Public Information Act, and the College’s and the District’s Records Retention Laws.
    • Neither Party will provide personally identifiable student information or other student data to the other Party except as authorized by law, and except to the extent required to comply with this Agreement.
    • Each Party will follow the applicable requirements and procedures as contained in applicable state and federal laws including, FERPA, Texas Education Code, Chapter 37, and Texas Administrative Code, Chapter 247, and requirements for access to Texas Education Agency data and confidentiality of student educational records. (TAC, TPF, 1, Chapter 4, Subchapter D, Section 61.087, and FERPA requirements (20 U.S.C. §1232g)).

SECTION 15. CONFLICT RESOLUTION

Conflicts should be resolved at the lowest level possible with an understanding that, if unsuccessful, the Parties will attempt to resolve or arbitrate the conflict through each Party’s organization. The key approach will be to maintain communications with early discussion against non-escalation and solutions provided prior to higher level escalation. In order to be collaborative, the College must be able to communicate with the administrators on campus in which the dual credit students/programs are present.

Each Party shall designate an administrative liaison for the purpose of resolving concerns at both the campus (liaison must be Principal or other designated campus administrator) and other College level (Director, Dual Credit Programs). If a resolution is not found at that initial level, the conflict will proceed through Management—next designated level administrator (such as a District Director or Assistant Superintendent of Instruction) and designated College level administrator (Director, Prospective Student Relations and Position in Management). If the conflict continues the issues will be resolved at District level Directors/Chancellors and through the Parties’ respective Boards of the College. If a resolution is not found through these channels, legal recourse may be had through the courts of the County in which the Parties reside, as applicable.

SECTION 16. TERM AND TERMINATION

  1. Term. The Term of this Agreement shall commence upon the Effective Date (Commencement Date) and shall be effective for one academic year or until either Party elects to terminate this Agreement by providing at least sixty (60) days’ written notice to the other Party. “Academic year” includes the following Summer, Fall, and Spring terms (for example, the 2024-2025 Agreement will begin Summer 2024, and conclude at the end of Spring 2025). Either Party may terminate this Agreement by providing sixty (60) days’ written notice to the other Party. If this Agreement is terminated, the Parties will work together to the extent reasonably feasible to allow students enrolled at the time of termination to complete their dual credit courses.

SECTION 17. GENERAL CONTRACT TERMS

  1. Entire Agreement. This Agreement, including the Recitals, the Appendices, and any exhibits, all of which are incorporated herein, constitutes the entire agreement of the Parties regarding the subject matter herein. The Parties acknowledge that in entering into and signing this Agreement the Parties rely solely upon the representations and agreements contained in this Agreement and no others.
  2. Amendments. This Agreement may be modified and amended only by written agreement between the Parties, and any such modifications or amendments shall be reduced to and become a part of this Agreement.

        College Station, TX 77840
        Attn: Superintendent
  4. Either Party may change its notice address at any time by giving written notice to the other.
  5. Relationship of the Parties. In the performance of their respective duties hereunder, the Parties hereto and their respective employees and agents, are at all times acting and performing as independent contractors of each other (notwithstanding the foregoing, employees of the District may teach dual credit courses as adjunct professors of the College or through some other teaching arrangement, if such arrangement is approved in advance by the Parties). This Agreement does not create a partnership or joint venture between the parties hereto, nor does it appoint or authorize either Party to serve as the legal representative or agent of the other. No Party will have the authority to act for or bind another Party in any respect or to incur or assume any expense, debt, obligation, liability, or responsibility on behalf of or in the name of another Party hereto. Neither party shall have control over the other party with respect to hours, time, employment, etc. The Parties acknowledge and agree that no Party will be liable to the other for any actions, acts, fines, penalties, claims, or damages of any kind arising out of this Agreement.
    • No Waiver. Any waiver by a Party of any right arising under or provision of this Agreement must be in writing and executed by an authorized officer of the Parties.
    • No waiver by a Party hereunder will be implied by any act or omission of such Party. No waiver by a Party hereunder will constitute a waiver of any other right or remedy. Any delay, forbearance, or failure by a Party to exercise or enforce any right or remedy hereunder, or the result of the lapse of time, will not constitute a waiver or otherwise prejudice the right of the Party to exercise or enforce such right or remedy thereafter. No single or partial exercise by a Party of any right or remedy will preclude any other or further exercise of such or any other right or remedy.
  6. Construction. Headings and titles used in this Agreement are intended only for convenience and will not affect the interpretation of the provisions hereof. In all cases, the terms “including,” “such as,” and words of similar import are to be deemed as if followed by the words “without limitation.”
  7. Binding Nature. This Agreement is binding upon, and inures to the benefit of, the Parties and their respective successors and permitted assigns. Nothing in this Agreement, whether expressed or implied, is intended to provide any rights or remedies to any person or entity not a party to this Agreement, or shall be construed as creating a relationship in the nature of a third-party beneficiary or fiduciary.
  8. Counterparts; Electronic Signatures; Electronic Transmissions. This Agreement may be executed in identical counterparts, all of which will be deemed an original, but all of which will constitute one and the same instrument. Each Party may rely on facsimile or electronic signatures of such persons if such facsimile or electronic pages were originals. The Parties consent to receive documents, information, and notices via electronic mail.
