AGREEMENT FOR THE BLINN COLLEGE DISTRICT DUAL CREDIT PROGRAM

This Agreement, known as the Dual Credit Program (Agreement) is entered into by and between BLINN COLLEGE DISTRICT, a public community college established under Chapter 130 of the Texas Education Code and a political subdivision of the State of Texas, and:

a Texas Public independent school district and political subdivision of the State of Texas, (District) with an effective date of June 1, 2024 (Effective Date). Individually, the College and the District may be referred to as “Party” and collectively as “Parties.”

RECITALS

WHEREAS, Texas Education Code (TEC) §§ 130.008, 28.152, 29.184, and 130.008; and 19 Texas Administrative Code (TAC) Chapter 4, Subchapter D of this Chapter, & Subchapter H authorize and/or require the College to enter into contract with a public school district for the purpose of instruction in college-level courses received in high school for such course; and

WHEREAS, it is the intent of the District desire to establish a dual credit program designed to meet the educational needs of students of the District School;

NOW THEREFORE, for the mutual promises and benefits set out herein and other good and sufficient consideration, the Parties agree as follows:

SECTION 1. GENERAL CRITERIA

A. Blinn College District (College)

  1. The College is a public community college defined as a junior college under Texas law and operates under the authority of the Texas Higher Education Coordinating Board (THECB). The College is accredited by the Southern Association of Colleges and Schools Commission on Colleges to award associate degrees and certificates of completion.
  2. In accordance with Applicable Law (as hereinafter defined), the College will offer dual credit courses listed in the current edition of the Texas Higher Education Coordinating Board’s (THECB) Lower Division Academic Course Guide Manual (ACGM) and Workforce Education Course Manual (WECM). Courses offered in each semester shall be determined by the College and agreed upon by the District/School. Courses provided by the College under this Agreement shall be consistent with the educational purpose, mission, and goals of the College and shall be within the scope of the College for the College. Developmental courses are not eligible for dual credit students. Kinesiology courses that count towards the high school graduation physical education requirement will not be offered to dual credit students.
  3. Dual credit courses may be offered during any semester in a location and classroom adequately served by the School and College. The College will seek every opportunity to use the available technology as appropriate to support dual credit sites.
  4. The District is responsible for ensuring that dual credit students meet the Texas Essential Knowledge and Skills (TEKS) requirements for high school graduation and will be used to equate high school courses with college courses. Such equivalency decisions can be supported by additional documentation (Crosswalk/Sequence of Courses). For all dual credit classes, access to curriculum documents determined by the District that is required for the course (commonly referred to as SDE forms and/or course scope and sequence). Readiness Assessment (TSI) and other requirements for high school courses, and all forms, documentation, and procedures are required for the dual credit classes.
  5. Dual credit courses may be offered in the classroom, online, or in a blended or hybrid format, as agreed upon by the College and District. Students taking online dual credit courses must have ready access to the appropriate technology.
  6. The College will collaborate with the District to provide orientation and registration assistance, as well as advising information about pathways and course selections suitable for dual credit students.
  7. The College will maintain the right to cancel a class if minimum enrollment is not reached prior to the start of the class. The School/District will be notified of the right to cancel the course.
  8. The College strongly encourages dual credit students taking classes online to have an in-school time scheduled to work with a high school proctor.

B. The School

  1. The School is responsible for providing a learning atmosphere and classroom facilities comparable to the ones offered on the College campus, regardless of modality of instruction.
  2. The School will provide instructional technology and other auxiliary equipment typically used in support of such instruction.
  3. The School will provide facilities, personnel, and equipment to meet the particular requirements for the online/internet, Interactive Video Conference (IVC). Appendix B describes video class regulations.
  4. The School will assign professional-level personnel, as applicable and as agreed upon between the Parties, who will be responsible for identifying, scheduling, and monitoring local and online students' participation in the Dual Credit Program including but not limited to the following:...
  5. The School/District will initiate the process for enrolling eligible students in dual credit classes, including supporting documentation. College registration is based on student's eligibility as provided by law. Students pursuing dual credit may follow the College's Student Code of Conduct and other regulations found at: https://www.blinn.edu/catalog/index.html.
  6. Whereas the College will follow existing Board of Trustees policies with regard to assigning grades for College credit in the dual credit courses, if the College grading scale conflicts with the District/School grading scale, the District/School will provide participating students with a comparative document displaying both the College grading scale and the District's grading scale. See Appendix A.
  7. Although a student may pass a College class with a grade of D, the District/School will be responsible for communicating to students and parents that (under 19 TAC § 74.26), credit for courses for high school graduation can be earned only if the student received a grade of at least 70 on a scale of 0-100 or a grade of C or better, depending on local policies.
    Therefore, dual credit students with D drops will be recorded as a W and will not be permitted to enroll in the allowed six-attr-drops.

C. Applicable Law

  1. The Parties agree to operate the Dual Credit Program and perform their obligations under this Agreement in compliance with all applicable Texas state statutes, laws and rules, and applicable federal requirements including, but not limited to, (a) the following federal laws and regulations: Title VI of the Civil Rights Act of 1964, Section 504 of the Rehabilitation Act of 1973, and Title IX of the Education Amendments of 1972, the Americans with Disabilities Act (ADA); and (b) applicable state laws, including the Texas Education Code, the Texas Administrative Code, FERPA, and the rules and guidelines set forth by the Texas Higher Education Coordinating Board (THECB).
  2. Any and all claims, disputes, or controversies arising out of or relating to the subject matter of this Agreement collectively shall be referred to as “Applicable Law” or “Applicable Laws” where the context requires.
  3. The Parties agree:
    • To certify that their sites are Americans with Disabilities Act (ADA) compliant.
    • To comply with all applicable provisions of the Family Education Rights and Privacy Act, 20 U.S.C. §1232g;
    • In all cases, to comply with all federal, state, and local laws applicable to this MOU; and
    • To have in place policies and policy prohibiting discrimination, including harassment, based on age, race, color, national origin, religion, sex, including pregnancy, gender, sexual orientation;

BLINN COLLEGE DISTRICT NOTICE OF NONDISCRIMINATION

BLINN COLLEGE DISTRICT STATEMENT ON PARENTING SERVICES

Any student who, because of their pregnancy or parenting status, may require special arrangements in order to meet the course requirements should contact the Parenting Services Office. Please note that the instructor is not allowed to provide classroom accommodations to a student until verification from the Parenting Services Office has been provided. For additional information, please contact the Parenting Services Office.

SECTION 2. DUAL CREDIT ADMISSION – STUDENT’S REQUIRED ACTIONS

Students may attend the College during the semester(s) in which the student demonstrates readiness for college-level courses or otherwise is eligible in accordance with Applicable Law. The following requirements must be met:

  1. Obtaining written or electronic permission from the high school principal or designee as outlined in Appendix C.
  2. Earn a “B” or better average in the course subject in question or a “C” for technical dual credit, and meet Texas Success Initiative (TSI) or applicable requirements for course placement
  3. File a completed dual credit application for admission to College.

  4. Proof of Bacterial Meningitis Vaccine. The College, in compliance with TEC § 51.9192, requires the bacterial meningitis vaccination for all new students enrolling in classes after January 1, 2012. Students must provide it to the College Enrollment Services Office or a certificate signed by a health practitioner indicating they have been vaccinated against bacterial meningitis. This requirement does not apply for students enrolled in the Dual Credit Program who will take classes exclusively at a School facility, or for completely online students. Dual credit students taking classes in-person at Blinn College Campus must provide proof of the meningitis vaccination. B. Students who are enrolled in private or non-accredited secondary schools, or who are homeschooled must meet all admission requirements for dual credit students.

SECTION 3. CLASSES AND SCHEDULES

  1. Prior to the start of each semester, the College will coordinate and finalize the proposed course schedule with the School in a timely manner. To facilitate program delivery and course section planning, both the School and the College agree to provide all course section schedule information as early as possible and prior to the beginning of that school year. The School will submit the proposed “articulation agreement” for review by both parties for each applicable semester by the deadline identified by the College.
  2. If a School desires to include face-to-face College instruction on the School’s campus, students participating in the College dual credit arrangement may attend classes at the School or at a College location, as specified in the program agreement.
  3. If a School requests a college course not listed in this agreement, the School shall submit the request to the College for review and consideration.
  4. If approved by both Parties, dual credit students may enroll in College workforce courses or classes per the applicable College catalog, technical course plan, or program plan. For articulated courses, the dual credit class can include a combination of technical dual credit students, college credit students, and/or local articulation students.
  5. In order for the College to provide face-to-face instruction for an academic dual credit course on the School’s or another high school campus, the campus must be within a reasonable commuting distance from a College campus, a minimum class size or number will be required. The Parties agree that the minimum number of students for a class for which the College will schedule face-to-face instruction may be composed of students from the District/School as well as one or more other school districts or educational institution. If there are fewer than the minimum number of students required, the Option of Dual Credit Program will confer with the District’s dual credit representative to explore instructional alternatives. The College will not be responsible if the minimum enrollment is not met.
  6. If the College provides face-to-face instruction on the School’s campus, students participating in the College dual credit arrangement may attend classes at the School or at a College location, except the instructional modality.

SECTION 4. FACULTY

The faculty assigned to provide instruction in the dual credit courses must be eligible for credentialing guidelines posted by the College. Each new and eligible instructor for a dual credit course will complete the College’s faculty credentialing requirements as determined by the College, including but not limited to background checks, FERPA, and other compliance training. The School will immediately notify the College of any instructor who is no longer employed by the School.

A dual credit instructor must be credentialed and approved by the College for each course section, adhere to College requirements for their instructional assignment, and deliver the College curriculum as provided to them by the College division dean or department head. The instructor will follow College standards for program/course assessments. The responsible staff for this program/course assessment includes the instructional faculty.

SECTION 5. FACILITIES

  1. Per SACSCOC accreditation guidelines, dual credit courses must be provided in appropriately physical facilities, whether under the control of the College or under the control of the School. The College will assess the facility prior to the beginning of instruction for classes scheduled at the School site.

College and District/School representatives at each site will assess the facilities, determine the schedule for use, and select the instructional modality.

SECTION 6. FINANCIAL AID FOR SWIFT TRANSFER (FAST) PROGRAM

The state of Texas has created the Financial Aid for Swift Transfer (FAST) program which provides funding to colleges to help cover dual credit courses to educationally disadvantaged students at no cost to their families. The Texas Education Code Title 3 defines “educationally disadvantaged” as those students eligible to participate in the national free or reduced-price lunch program established under 42 U.S.C. Section 1751 et seq.

  • Students are eligible under the FAST program if they (1) are enrolled in dual credit in a school district or charter school, (2) are educationally disadvantaged, and (3) satisfy the other eligibility requirements in the Administrative Rules for the FAST Program. Students must verify these requirements for the College. This verification must occur by August 5th.

Students are eligible to enroll in a dual credit course under the FAST program if the student meets the following:

  1. Is enrolled in a high school in a school district or charter school,
  2. Is enrolled in a dual credit course at a participating institution of higher education,
  3. Is educationally disadvantaged at any time during the student’s enrollment in the dual credit course described herein.

The College will work together to verify FAST-eligible students and dual credit students. The student and/or family will not be charged for courses for which tuition/mandatory fees are covered by FAST. The school or student will not be charged for such course if the student qualifies for the FAST program. The Student who is not eligible, or who qualifies, but is not funded will be responsible for the cost of the course and fees.

The District/School shall be responsible for informing the College of the district or school officials who have the authority to make such verifications of eligibility or submit the FAST eligibility form.

SECTION 7. TUITION

Students enrolling in academic courses through the Dual Credit Program will pay tuition and fees as required, unless tuition waivers are necessary or conditions for ACGM and WECM grants require consideration or exemption.

  • Option 1: If an instructor who is not an employee of the District or employer agrees to teach a dual credit course, students will pay the State of Texas approved tuition rate for the current academic year.
  • Option 2: If a qualified and approved instructor employed by the District is utilized for a course and the College sees open seats to seek the highest instructor as faculty credential ready, THEN a NON-FAST student would only pay $20 per credit hour (e.g., $60 for a three (3) credit hour course, $80 for a four (4) credit hour course). Additionally, under this option, the District will receive a reimbursement of service payment of $500 for each course section of dual credit. A minimum of eight (8) students are required for each course in the Dual Credit Program.
  • Option 3: If a qualified and approved instructor employed by the District is utilized for a technical (WECM) dual credit course and the College pays compensation to the instructor; THEN, the cost to the student for a College technical dual credit course will be the cost of such course less the amount that would have, if such student had taken a high school campus in a high school instructor). THEN, the tuition.

*During the first term hereinafter offered in this Agreement, the credit hour tuition and fees identified for the Dual Credit Program will be those established by the College for the State of Texas.

SECTION 8. COLLEGE PAYMENTS

A. Full-time College faculty will be compensated per teaching load and assignment.

SECTION 9. SYLLABUS, CURRICULUM, SUPPLIES, AND TEXTBOOKS

  1. The College will provide the adopted course syllabus, curriculum, and course outcomes for each course. Dual credit students will be subject to the same program, academic standards, and policies as standard college students, including exam schedules, academic dishonesty, and attendance policies.
  2. Course textbooks and related materials will be required as specified by the College.
  3. Supplies, equipment, and technology devices required for the course will be listed in the College catalog and course presentations. The responsible staff for this program/course assessment includes the instructional faculty.

As per HB 3650 (87th Legislature, 2019), the District/School and the College will consider the use of free or low-cost open educational resources in courses offered under this agreement. These resources will be reviewed by the responsible and collaboratively by academic personnel from the College and District/School.

As of August 2024, the College is an active participant in the Financial Aid for Swift Transfer (FAST) program. Students that are not eligible for Financial Aid for Swift Transfer (FAST) funds will be responsible for purchasing any required textbooks or additional resources required for the class. Students identified as FAST eligible will be provided with all required textbooks and materials free of charge. Costs of books and additional resources will be provided by the District.

SECTION 10. LIBRARY AND LEARNING RESOURCES

Dual credit students and instructors may use the library services located at each participating College Campus. Students may use the databases – College’s online library resource. Circulation privileges and use of on-campus services for students and instructors who are part of the Dual Credit Program are identical to those afforded to all College students.

SECTION 11. ACADEMIC ADVISING AND STUDENT SUPPORT SERVICES

  1. The College will provide adequate advising, dual credit orientation, and support services to dual credit students as set forth in the College Catalog and the website.

SECTION 12. STUDENT CODE OF CONDUCT

  1. Dual credit students must comply with College policies and procedures including the Student Code of Conduct as outlined in the College Catalog.
  2. Students must comply with the College’s academic integrity policies as it relates to academic integrity. ( http://catalog.blinn.edu/content.php?catoid=44&navoid=1184#scholasticintegrity-faculty-responsibility-and-student-duties)
  3. If a student is asked to leave the classroom because of unexcused behavior, the student may not return to that class section until after a meeting with the College’s discipline officer. It is the student’s responsibility to arrange for this conference. For information on involuntary protocol, please see the student appeals process in Blinn College’s policy, FLB.

SECTION 13. FUNDING AND PAYMENT

  1. Tuition and fee payments at the amounts set forth in Section 7 are due from the student/guardian, or may be paid by the school district, to the College by the payment deadline announced in the College’s academic calendar.
  2. Tuition and fee payments made by the student/guardian or school district after the College deadline will be subject to late payment fees as established by the College. Failure to make such payments as required may result in automatic withdrawal from the course.
  3. Financial responsibility for non-FAST-eligible dual credit students rests with the student/guardian, or may be paid by the school district.
  4. If students request to take a class more than twice, he or she will be responsible for the tuition of the course and a $50.00 per semester charge for the course. Technical courses and FAST-eligible students are exempt from this fee. (see Blinn College Catalog - College Expense).
  5. The College is not responsible for the transportation of dual credit students.

SECTION 14. RECORDS AND REPORTING

  1. Class Rosters. The College will provide class rosters (listing the names and grades in a numerical format of dual credit students completing the course) to the School at the close of each semester.
  2. Student Records; Record Retention; FERPA. In accordance with Applicable Law, each Party will maintain student records and make them as necessary or advisable to operate the Dual Credit Program; provide the other Party as necessary, data and progress, informational data on attainment and research studies and reports. Information required to establish eligibility for the FAST program may be shared with the Parties in compliance with applicable law and College policy regarding Record Retention laws. Each Party designates the following officer as its agent for FERPA-related matters: (section provided in agreement). Each Party will comply with FERPA, including but not limited to, compliance with limitations or disclosure of student records to the other Party. Appendix A provides a copy of the current College grading policies applicable for reporting dual credit coursework.

Conflicts should be resolved at the lowest level possible with an understanding that, if no agreement is reached, there is a procedure for advancing the conflict through each Party's organization. The key approach will be to maintain communication with early discussion sought on issues/conflicts and solutions summarized in writing after each discussion. In order to be collaborative, the College must be able to communicate with the administrators on campus in which the dual credit students/programs are housed.

Each Party shall coordinate and administrate liaison for the purpose of resolving conflict at both the campus liaison must be Principal or other designated campus administrator and the College level (Director, Dual Credit Program). If resolution is not found at that local level, the conflict resolution program shall move to a designated District level administrator (such as District Director or Assistant Superintendent for Instructional Services) and a designated representative of the College (Director or Executive Dean of Educational Partnerships and Instruction). If the conflict continues the then process shall move at both parties to the Chancellor and the Vice Chancellor, Instructional Divisions for the College. If a resolution is not found through the sequential approach, legal support will be made as the next step.

SECTION 16. TERM AND TERMINATION

A. Term. The Term of this Agreement shall commence on the Effective Date (Commencement Date) identified above and remain in effect until terminated as set forth herein or upon the termination of the Dual Credit Program. A Party may terminate this Agreement upon thirty (30) days’ written notice to the other Party with or without cause. The parties may extend the term of this agreement by a signed written agreement by both Parties. Dual credit students who have enrolled in a course as of the date of termination may continue to enroll in such course for the remainder of the current semester or, if applicable, the next full college term. No new dual credit students may be enrolled after termination, except by written mutual consent of the Parties.

B. Termination for Convenience. Either Party may terminate this Agreement, in whole or in part, for its convenience upon thirty (30) days’ written notice to the other Party.

SECTION 17. GENERAL CONTRACT TERMS

  1. A. Entire Agreement. This Agreement, including the Recitals, the Appendices, and any of which are incorporated herein, constitutes the entire agreement between the Parties with respect to the subject matter herein described. This Agreement supersedes all acquisitions or previous agreements between the Parties with respect to the subject matter hereof. The Parties expressly acknowledge that in entering into and executing this Agreement the Parties rely solely upon the representations and agreements contained in this Agreement and no others.
  2. B. Amendments. This Agreement may be modified and amended only by written signature of both Parties, and any such modification or amendments shall be attached as appendices to this Agreement.
  3. C. Governing Law; Venue; This Agreement and the parties obligations herein shall be performed under, governed by, and interpreted in accordance with the laws of the State of Texas without regard to its conflict of law provisions. The parties irrevocably consent to the sole and exclusive jurisdiction and venue of the courts of Washington County, Texas for any action regarding this Agreement.
  4. D. Relationship of the Parties. In the performance of their respective duties hereunder, the Parties hereto and their respective employees and agents are, at all times acting and performing as independent contractors of each other (notwithstanding the foregoing, employees of the District may teach college courses as adjunct professors of the College or through some other teaching arrangement, if such arrangement is approved in advance by the Parties). This Agreement does not create a partnership or joint venture between the parties hereto, nor does it authorize either Party to serve as the legal representative or agent for the other. No Party will have the authority to act for or bind another Party in any respect or to incur or assume any expense, debt, obligation, liability, tax, or responsibility on behalf of the one in the name of another Party hereto. Neither party shall have power to bind the other party with respect to its legal obligations. No partnership, joint venture, agency, or third party, will be liable for the acts/omissions of another Party, including, and not limited to, liabilities, losses, damages, suits, actions, fines, penalties, claims, or demands of or by third parties of any kind or nature.
  5. E. No Waiver. A waiver by either Party of any right under or provision of this Agreement, or any failure to perform or breach by either Party, shall not operate as a waiver of any other right or waiver of a subsequent failure to perform or breach by either Party, nor will such a waiver be deemed to be continuing. No waiver of any right or privilege or of the enforcement of any right or privilege of either party will be effective unless such waiver is in writing and is executed by the party charged with such waiver.
  6. F. Severability. If any provision of this Agreement is found to be invalid, illegal, or unenforceable, the remaining provisions will not be affected or impaired and will be enforced so far as possible.
  7. G. Assignment. This Agreement may not be assigned by either party without the prior written consent of the other party.
  8. H. Notices. Notices hereunder by either party shall be in writing and delivered (1) personally, (2) by email with confirmation or by U.S. certified mail, postage prepaid, and return receipt requested, addressed as set forth in this Agreement or to such other person(s) or address(es) as any party may designate by notice to the other party.

  9. I. No Third Party Beneficiary. This Agreement is made and entered into only for the purpose of the direct benefit of the Parties and their respective successors and permitted assigns. No other person or entity shall have any rights of any kind under this Agreement as a third-party beneficiary or otherwise.
  10. J. Counterparts; Electronic Signatures; Electronic Means Page
    This Agreement may be executed in identical counterparts, all of which will be deemed an original, but all of which will constitute one and the same instrument. Each Party may rely on facsimile or electronic signatures pages as if such facsimile or electronic pages were originals. The Parties consent to receive documents, information, and notices via electronic mail.

APPENDIX A
Regarding Grading System
EGA(LOCAL) and Current College Procedures for Grading and Credit

The Board shall establish the manner by which grades shall be determined and credit awarded. Such procedures must include the methods for reporting student grades, the calculation of a student’s grade point average (GPA), the classification of students based on the number of credits earned, the ranking and standards of performance, grade appeal procedures, and any other relevant matters. The procedures shall be published in the College District catalog. The Chancellor shall develop procedures for the assignment of credit and credit programs adopted by the Board.

CURRENT COLLEGE PROCEDURES FOR GRADING AND CREDIT

Grades
At the end of each semester, students shall receive a final grade report that shall become a part of their permanent record. The College’s grading scale shall apply to all courses:

  • A (90-100) - Excellent
  • B (80-89) - Good
  • C (70-79) - Satisfactory
  • D (60-69) - Poor F (Below 60) - Failing
  • W - Withdrawal
  • Q - Q-Drop
  • NP - Non-credit Course or Withdrawal From Course
  • FS - Academic Fresh Start
  • I - Incomplete: indicates that the coursework was incomplete because of serious illness or other justifiable emergency. [...]
  • Q-Drop: assigned before or on the official “Q-Date” as indicated on the College calendar when a student drops a class.
  • W - Dropped: assigned after the “Q-Date” if the student is passing the course at the time of official drop.

Health Sciences
The grading system for Health Science programs may differ from the approved College Grading Scale as noted in their program handbook and course syllabi.

Grade Point Average (GPA)

College progress is ordinarily measured by a grade point average (GPA). Grade points shall be calculated by assigning values to each grade. A = 4, B = 3, C = 2, D = 1, F, I, W, Q, NP, FS = 0.

All grades earned will be included in the College shall be used in computing a cumulative grade point average (GPA), except grades of I, W, Q, NP, FS, and other noncredit grades.

Academic Good Standing

A student must maintain a cumulative grade point average of at least 2.0 (C). A 2.0 cumulative grade point average is the minimum average required for graduation.

Scholastic Probation or Suspension

A student who falls below a 2.0 cumulative grade point average (GPA) at the close of any long semester or summer session may be placed on scholastic probation. A student who fails to achieve a minimum 2.0 semester and cumulative GPA at the end of subsequent semesters will be placed on scholastic suspension. A student with a semester GPA of greater than 2.0 and a cumulative GPA of less than 2.0 will remain on scholastic probation.
